برزت عقوبة الجلد للأفراد منذ فجر التاريخ لمعالجة بعض الحالات السلبية في المجتمعات الإنسانية على مر العصور، للحد من جرائم الفساد الأخلاقي وغيرها من الجرائم التي كان يرتكبها البعض بحق الآخرين. وتهدف هذه العقوبة إلى تحقيق مصلحة الفرد والمجتمع كي يعيش بأمان واطمئنان، لأن الهدف الأساس منها هو تقويم الفرد وإصلاح الجاني وتهذيبه، كما يمكن من خلالها الوقوف بوجه كل من يفكر بارتكاب ذلك الجرم بأن هناك عقوبة تنتظره، ويمكن ملاحظة ذلك من خلال النظر في خصوصيات الأمم وتواريخها عربية كانت أم غير عربية، ولأهمية هذه العقوبة في المجتمع الإسلامي نجد أن الله سبحانه وتعالى قد جعلها تشريعا في أكثر من موضوع في القرآن الكريم، كذلك استخدمها الرسول صلى الله عليه وسلم والخلفاء الراشدون رضي الله عنهم تطبيقا لما ورد في القرآن الكريم، كذلك في معالجة حالات أخرى بوصفها عقوبة تعزيرية. لذلك جاء هذا البحث ليعطي صورة عن عقوبة الجلد منذ التاريخ القديم وحتى نهاية العصر الراشدي. قسم البحث إلي مبحثين رئيسيين جاء المبحث الأول تحت عنوان معني الجلد والألفاظ الدالة عليه وجذور التاريخية، واشتمل هذا المبحث علي معني الجلد في اللغة والاصطلاح ، فضلاً عن بعض المفردات التي تدل علي معني الجلد والتي نابت عنه في بعض الأحيان. كما تناولهذا المبحث أيضاً عقوبة الجلد عند الأمم الأخرى غير العربية، وفي القوانين العراقية القديمة، فضلاً عن عقوبة الجلد عند العرب قبل الإسلام ، وقد أندرجت كلها تحت عنوان الجذور التاريخية لعقوبة الجلد. أما المبحث الثاني فقد جاء تحت عنوان عقوبة الجلد في عصري الرسالة والخلافة الراشدة، وقد قسم إلي نقاط رئيسة ابتدأت بمشروعية عقوبة الجلد في القرآن الكريم ، وأسباب عقوبة الجلد في العصرين المذكورين ، وركزنا في هذا الجانب علي عقوبة الزانية والزاني ، والجلد في القذف ، وفي شرب الخمر ، وفي القصاص ، وفي إساءة استخدام السلطة ، فضلاً عن أسباب أخري . وتطرق هذا المبحث إلي ابراز الآثار التي ترتبت علي هذه العقوبة في العصرين المذكورين.
