|a رغم ما يشكله الإرهاب من أهمية وخطورة بالغة على الدول و المجتمعات، إلا أن الدول و المنظمات الدولية غير قادرة على وضع تعريف محدد للإرهاب، فتجربة الدول في التعامل مع الإرهاب مختلفة كما أن هناك اختلاف في الأسباب الكامنة وراء حدوث الأعمال الإرهابية، حيث أن التشريعات القانونية لمعظم الدول غير متفقة أحيانا حتى على كون الإرهاب جريمة مستقلة لها أركانها الخاصة أو أنها مجرد ظرف مشدد أو وسيلة لتنفيذ جرائم أخرى فتسمى أحيانا بالجريمة الإرهابية و أحيانا أخرى بالجرائم الإرهابية . وهناك موضوع آخر شائك وهو تحديد قواعد المسؤولية الجنائية الدولية للدول و الأفراد الضالعين في ارتكاب أعمال الإرهاب الدولي، حيث مازال موضوع تحديد الأسس القانونية الدولية الخاصة بالمسؤولية الجنائية للدول محل أخذ ورد في الفقه والتشريع الدوليين.

|b Despite what terrorism poses important and extremely dangerous to the countries and communities but nations and international organizations are not able to develop a specific definition of terrorism The experience of countries in dealing with various terrorism as there is a difference in the underlying causes of the incidence of terrorist acts since the legislation of most countries is sometimes even in agreement on the fact that terrorism has its own independent crime corners or is it just an aggravating circumstance or means to carry out other crimes sometimes is called a terrorist crime, and sometimes other terrorist offenses. Another thorny issue is to determine the rules of international criminal responsibility of states and individuals involved in the commission of acts of international terrorism which is still the subject of defining international legal grounds for the criminal responsibility of states took place and responded in jurisprudence and international legislation.
