المستخلص: إن الطبيعة القانونية الخاصة لعقد العمل تحت التجربة فرضت على المشرع إقرار بعض الأحكام الخاصة، التي كان لها بالغ الأثر على المركز القانوني للعامل أثناء هذه الفترة. ومن هذا المنطلق حاولنا في هذا البحث الإجابة على الإشكالية التالية: إلى أي مدى يوفر المركز القانوني للعامل تحت التجربة الحماية الكافية له من تعسف صاحب العمل؟
وفي محاولة للإجابة عن هذه الإشكالية، تناولت هذه الدراسة بالأسس التكييف القانوني لعقد العمل تحت التجربة في المبحث الأول. والأحكام الخاصة المرتبطة بهذا العقد وما تثيره من تساؤلات قانونية حاولنا الإجابة عليها في المبحث الثاني. وتضمن المبحث الثالث مقارنة بين المركز القانوني للمواطن والعمل تحت التجربة.
كما تضمن البحث أيضاً خاتمة احتوت على بعض النتائج والمقترحات التي نعتقد بوجود فائدة عملية من الأخذ بها في إطار الحياة القانونية.

The special legal nature of the labor contract on trial has forced the legislator to adopt certain special provisions, which have had a significant impact on the legal status of the worker during this period. From this point of view, we tried to answer the following problem: To what extent the legal status of the worker under trial does provide adequate protection against abuse by the employer?
In an attempt to answer this problem, this study examined the legal qualification of the contract of employment under trial in the first chapter and the special provisions relating to this contract and the legal questions it raises, which we have tried to answer in the second chapter. The third subject included a comparison between the legal status of the citizen and the work under trial.
The paper also included a conclusion that contained some findings and suggestions that we believe would be of practical benefit from taking them into legal life.

La nature juridique spéciale du contrat de travail pendant la période de probation a poussé le législateur à prévoir des dispositions spéciales qui ont eu un impact profond sur le statut juridique du travailleur durant cette période. Dans cet esprit, nous avons essayé de répondre à la problématique suivante: est-ce que le statut juridique du travailleur sous probation lui garantit une protection adéquate contre l'arbitraire de l'employeur? .
Afin de répondre à cette problématique, cette étude essaye d’abord de cerner la qualification juridique du contrat de travail pendant la période de probation, dans la première section. Les dispositions spéciales relatives à ce genre de contrat et les questions juridiques y afférentes sont discutées dans une deuxième section. Quant à la troisième, elle comprend une comparaison entre le statut juridique du travailleur sous probation et celui du fonctionnaire pendant la même période.
La recherche contient des résultats et des propositions que nous croyons être bénéfiques sur le plan pratique de la vie juridique.
