المستخلص: يسعى هذا المقال لإبراز أن الدولة الحديثة بمعناها الواسع السياسي والمدني القانوني لا تقوم إلا على قاعدة وجود مجتمع سياسي متعدد ومجتمع مدني أكثر تعدد، يستندان إلى نفس المبادئ والقيم الديمقراطية في إدارة شؤون المجتمع ككل. فالمجتمع السياسي من جانبه يهدف في نهاية المطاف إلى الوصول إلى السلطة أو المشاركة فيها (الأحزاب الحاكمة وأحزاب المعارضة)، والمجتمع المدني من جانبه لا يسعى للوصول إلى السلطة بل يعمل على السهر بصفة جماعية على أن تطبق مؤسسات الدولة روح القوانين بصفة عادلة بما يساهم في إفضاء فضائل النمو في ظل التوازن الاجتماعي.
غير أن المجتمع الجزائري الحديث تشكل في ظروف خاصة ذات علاقة بالحقبة الاستعمارية وثورة التحرير، انتقالا إلى الاستقلال ومقتضيات بناء مؤسسات الدولة في ظل نظام حكم يهيمن على مفاصل الدولة في ظل الأحادية والتعددية الشكلية. وهو ما ساهم في ظهور اختلالات يسعى المجتمع المدني والسياسي إلى التقليل منها لتحقيق التوازن الاجتماعي دائم.

Cet article vise à mettre en évidence le fait que l'Etat moderne dans le sens large du droit politique et civil ne se fonde pas seulement sur l'existence d’une société politique et civile partageant les mêmes principes et valeurs de la démocratie dans la gestion des affaires de la société entière. La société politique a pour objectif principal d'accéder au pouvoir ou d’y participer, tandis que la société civile ne cherche pas à accéder au pouvoir, plutôt elle veille collectivement que les institutions de l'Etat appliquent l’esprit de la loi de façon équitable qui contribue à répandre les vertus de la croissance dans le cadre de l'équilibre social . Cependant, la société algérienne moderne a été formée dans des circonstances spéciales liées à l'époque coloniale et la révolution algérienne, une transition vers l'indépendance et la construction des institutions étatiques sous la domination d'un système qui contrôle les rouages de l'Etat sous l'unilatéralisme et le multipartisme formel. Ce qui a contribué à l'émergence de déséquilibres que les sociétés civile et politique cherchent à atténuer afin d’atteindre l'équilibre social permanent.

This article seeks to highlight that a modern state in its broad political and civil legal sense is based only on the existence of a pluralistic political society and a more pluralistic civil society, based on the same democratic principles and values in the management of society as a whole. The political society, for its part, ultimately aims to reach or participate in power (ruling parties and opposition parties) while the civil society does not wish power but seeks to ensure that state institutions apply the spirit of laws fairly, thereby contributing to the virtues of growth in the light of social balance.
However, modern Algerian society, in particular, circumstances related to the colonial era and the liberation revolution, constitutes a transition to independence and the requirements of building state institutions under a system of governance that dominates the joints of the State with unilateralism and formalistic pluralism. This has contributed to the emergence of imbalances that civil and political society seeks to reduce in order to achieve lasting social balance.
