تعتبر الملكية في الفقه الإسلامي من الموضوعات الهامة للغاية، وعلى أساسها قامت نظرية فقهية إنبري عدد من الفقهاء المعاصرين لإرساء قواعدها وتمثلت هذه الأهمية في ارتباطها بكثير من مسائل المعاملات، لذلك كان الاختيار لموضوع قيودها وضوابطها يجب مراعاتها بدءاً من التملك وانتهاءً بالتصرف. لذلك تمثلت المشكلة في ماهية الضوابط التي يجب مراعاتها في التملك والتصرف وما هي حدود هذه القيود والضوابط ويهدف البحث إلى اتجاه مجموعة من القواعد الحاكمة للملكية. اتبعت في هذا البحث المنهج الوصفي التحليلي المقارن. أهم ما توصلت إليه من نتائج تمثلت في أن الملكية تدور حولها كثير من الموضوعات في المعاملات، وأن المستخلص غير حر في ممارسة حقوقه في الملكية وإنما مقيد بضوابط تابعة من الشرع، كذلك يحق منع الشخص من ممارسة حقوقه من الملكية لأسباب عامة أو خاصة، وأن الشخص لا بد أن يراعى في تملكه وتصرفه هذه القيود والضوابط والا عد خروجه عن ذلك مخالفة.
Ownership in Islamic jurisprudence from the very important issues, and on the basis of the theory of jurisprudence kick, a number of contemporary scholars to establish the their rules and this represented important in a much of the issues relate to transactions, so choice was the subject of restrictions and controls must be observed starting from the end of the ownership and disposition, for that what represented the problem in the controls that must be considered in the ownership and disposition of what are the limits of these restrictions and controls, the research aims at the direction of a set of rules that govern the ownership. The study followed the descriptive analytical method comparative. The most important findings was that the Ownership revolve around many of the themes in the transactions, and extracted is not free to exercise his rights in the ownership but restricted controls a subsidiary of Shari'a, as well as the right to prevent a person from exercising his rights of ownership for reasons of public or private, and that the person must take into account in owned and disposal of these restrictions and controls or consider for so foul.
