المستخلص: يتمحور هذا المقال حول الحماية التي يحظى بها الطفل في ظل التشريعات الحديثة، وهذا من خلال التعرض لأحد أهم حقوق الإنسان ألا وهو الحق في سلامة جسده.
وقد تبين بعد تحليل النصوص القانونية لمختلف التشريعات ومقارنتها مع بعضها بأن الطفل لم یتحصل على الحماية القانونية اللازمة، خاصة في الشق الجزائي الأمر الذي جعل جرائم الاعتداء على الأطفال ترتفع معدلاتها من سنة إلى أخرى، وعليه فالدعوة قائمة لإعادة النظر في النصوص المتعلقة بالحماية الجنائية للأطفال.

Cet article porte sur l étude des nouvelles législations de la protection de l´enfant,il s’agit plus précisément étudier le droit àl intégrité physique de l´enfant. Après une analyse comparative des législations de différents pays, c’est avéré qu en Algérie l’enfant ne jouit pas de la protection juridique nécessaire,pénale notamment.
Il y a un vide juridique dans les cas de labus de force à l encontre des mineures, ce qui explique le grand nombre des infractions commises à l'encontre des enfants Ce qui nécessite une révision urgente des textes législatifs concernant la protection pénale des enfants

This article focuses on the protection for children under modern legislation. This is by exposing one of the most important human rights: the right to physical integrity.
After analyzing and comparing the legal texts of the various legislation, it was clear that the child did not receive the necessary legal protection, particularly in the penal area. This has led to an increase in the incidence of child abuse from year to year. Therefore, the call is underway to review the provisions on protecting children's rights in criminal justice systems.
