المستخلص: تتناول هذه الدراسة حماية الطفل في ظل التشريعات الحديثة، وهذا من خلال التعرض لأهم حق من حقوق الإنسان ألا وهو الحق في الحياة. وقد تبين بعد تحليل النصوص القانونية لمختلف التشريعات الداخلية للدول بعضها مع بعض بأن الطفل -سواء أكان حديث عهد بالولادة أم لم يكن -لم يتحصل على الحماية اللازمة، خصوصا في الشق الجزائي. الأمر الذي يجعل جريمة الاعتداء على حياة الأطفال ترتفع معدلاتها من سنة إلى أخرى، خصوصا ما تعلق بظروف التخفيف الممنوحة للأمهات، أو من حيث المتاجرة بالأعضاء، أين لا توجد نصوص خاصة بهذا السلوك، أو بالنسبة للخطف المقترن بالقتل، وعليه فالدعوة قائمة لإعادة النظر في النصوص المتعلقة بالحماية الجنائية للأطفال.

This article focuses on the protection of children as a part of the new legislation through the study of a fundamental right of human rights. It is a question of the right to life. After a comparative analysis of the laws of different countries, it was found that the child does not have the necessary legal protection, particularly in criminal matters. There is a loophole in the case of trafficking in human organs or kidnapping which leads to a homicide, in particular, with regard to mitigation conditions granted to mothers. That is why the rate of offenses against the lives of children is increasing year by year, which requires an urgent review of legislation regarding the criminal protection of children.

Cet article porte sur la protection de l’enfant dans le cadre des nouvelles législations, et ce, à travers l’étude d’un droit essentiel des droits de l’homme. Il s’agit du droit à la vie. Après une analyse comparative des législations de différents pays il s’est avéré que l’enfant ne jouit pas de la protection juridique nécessaire, notamment pour les questions pénales. Il y a un vide juridique dans les cas du trafic des organes ou d’enlèvement menant à un homicide¤ En particulier, en ce qui concerne les conditions d'atténuations accordées aux mères. C’est la raison pour laquelle le taux des infractions contre la vie des enfants a augmenté d’année en année. Ce qui nécessite une révision urgente des textes législatifs relatifs à la protection pénale des enfants.
