|f The issue of protection of the private life of the worker in the field of labour relations raises several problems, The main problem lies in the difficulty of reconciling the right of the employer to exercise his powers with the right of the worker to respect his private life.\nDuring the employment relationship, the private life of a worker may be affected by his or her professional life, due to a relationship of dependence that restricts the employee's freedoms. It subordinates it to the supervisory authority of the employer, who imposes continuous monitoring on workers within the employing body using electronic control means, which threatens their private lives. Therefore, the legislator intervenes and recognizes the right of workers to retain even at the time and place of the worker to exercise their right to private life, and prohibits the employer from interfering in them unless justified by the preservation of the legitimate interests of the enterprise.\nThis abstract translated by Dar AlMandumah Inc 2018.

|d La protection de la vie privée de l’employé dans le domaine du travail soulève plusieurs problèmes, surtout que le problème fondamentale réside dans la difficulté de concilier le droit de l’employeur d’exercer ces pouvoirs et le droit de l’employé au respect de sa vie privée.\nPendant la relation contractuelle, la vie privée de l’employé peut être menacée par sa vie professionnelle à cause du lien de subordination au pouvoir de l’employeur, cela pourrait relativement restreindre les libertés du travailleur, sous l’autorité de contrôle de l’employeur qui imposé un contrôle ou surveillance au sein de son entreprise, en utilisant des moyen de contrôle électroniques, et pour cela le législateur a reconnu le droit des travailleurs à se préserver et à exercer même au temps et lieu de travail leur droit à la vie privée, et il est interdit à\nl’employeur d’intervenir sauf s’il est justifié de maintenir les intérêts légitime de l’établissement.

|a تثير مسألة حماية الحياة الخاصة للعامل في ميدان علاقات العمل عدة إشكالات، وتكمن الإشكالية الأساسية في صعوبة التوفيق بين حق صاحب العمل في ممارسة سلطاته وحق العامل في احترام حياته الخاصة.\nفأثناء سريان علاقة العمل قد تتأثر الحياة الخاصة للعامل بحياته المهنية، بسبب علاقة التبعية التي تقيد نسبيا حريات العامل، فتجعله تابعا لسلطة الإشراف لصاحب العمل الذي يفرض المراقبة المستمرة على العمال داخل الهيئة المستخدمة باستعمال وسائل الرقابة الإلكترونية مما يهدد حياتهم الخاصة، ولهذا تدخل المشرع وأقر حق العمال بالاحتفاظ حتى في زمان ومكان العامل بممارسة حقهم في الحياة الخاصة، وحظر على صاحب العمل التدخل فيها ما لم يبرره المحافظة على المصالح المشروعة للمؤسسة.
