The conformity of products and services to legal standards and specifications is mandatory for both domestic and imported products, under the pretext of protecting the health of the consumer and ensuring his safety against all kinds of risks. Several bodies or structures intervene in this field where they have been given powers of different nature, including advisory, representative, etc. In the event of a lack of conformity, a number of measures are taken under the law on consumer protection and prevention of fraud, temporary and final withdrawal of the product, closure of the product and destruction of the product by the company. La conformité des produits et services aux spécifications et aux normes est une règle obligatoire soit pour les produits locaux ou importés afin de protéger la santé du consommateur et d’assurer sa sécurité des risques prévus. Le législateur algérien a émis des organes dans le but d’assurer la mission de normalisation , on leurs attribuant plusieurs pouvoirs. Dans le cas de défaut de conformité , le législateur a consacré à travers la loi relative à la protection du consommateur et de la répression des fraudes, des mesures à savoir le retrait temporaire ou définitif du produit , la fermeture de l’entreprise, la saisie du produit. إن مطابقة المنتوجات والخدمات للمقاييس والمواصفات القانونية أمر إلزامي سواء للمنتوجات الوطنية المحلية أو للمنتوجات المستوردة، وذلك بحجة حماية صحة المستهلك وضمان سلامته من المخاطر بجميع أنواعه. تتدخل عدة هيئات أو هياكل في هذا المجال حيث خولت لها صلاحيات تختلف طبيعتها منها الاستشارية ومنها التمثيلية...إلخ في حالة ثبوت عدم المطابقة تتخذ عدة تدابير كرسها المشرع الجزائري ضمن القانون المتعلق بحماية المستهلك وقمع الغش منها، السحب المؤقت والنهائي للمنتوج، غلق المؤسسة حجز المنتوج وإتلافه. |
