|f Sale by reduction is considered one of the promotional practices on which economic aid often relies in order to attract consumers and encourage them to contract. Due to the prevalence of such practice in our country, the legislator has regulated it and given it a legal framework in order to protect the consumer and also control the market, as it restricted the freedom to exercise it, allowing it only twice a year and stipulated the necessity of having certain characteristics in the goods subject to sale by reduction and regulating publicity as it is considered to be one of the essential elements on which such practices rely. Therefore, the problem in our intervention is to look at how to frame the practice of such a sale and how to take into account consumer protection.\nThis abstract translated by Dar AlMandumah Inc 2018.

|d Les soldes sont considérés comme une pratique de promotion de vente, c’est un outil important pour l’opérateur économique afin de cibler le consommateur et l’inciter à contracter, vu la généralisation de cette pratique dans notre pays, et pour assurer l’organisation et le cadre juridique, dans le but de protéger le consommateur et la régulation du marché, l’intervention du législateur tend à limiter la pratique de la réduction de prix à deux fois par an pas plus, et il a exigé des spécificités bien définies des produits présentés à la vente, par la réduction de prix, et même la publicité est réglementée relativement à son importance dans ce type de vente. Dans notre intervention découle la problématique de l’encadrement juridique dans ce genre de vente, et ses effets sur la protection du consommateur.

|a يعتبر البيع بالتخفيض ممارسة من بين الممارسات الترويجية التي غالبا ما يعتمد عليها العون الاقتصادي بهدف استقطاب المستهلك وتحريضه على التعاقد، ونظرا لانتشار مثل هذه الممارسة في بلادنا فقد عمد المشرع إلى تنظيمها وإعطائها إطارا قانونيا شرعيا بغية حماية المستهلك وضبط السوق أيضا، إذ قيد حرية ممارستها فسمح بذلك خلال مرتين في السنة لا أكثر واشترط ضرورة توافر خصائص معينة في السلع موضوع البيع بالتخفيض كما نظم الإشهار حولها نظرا لاعتباره من بين العناصر الأساسية التي يعتمد عليها في مثل هذه الممارسات. وعليه فإن الإشكال المتناول في موضوع مداخلتنا هو البحث عن كيفية تأطير ممارسة مثل هذا البيع ومدى مراعاة حماية المستهلك في ذلك.
