|f The Constitutional Council is one of the most important constitutional institutions in Algeria. It enjoys important powers making it occupy such a standing, especially in the electoral domain, and in particular in respect to the presidential elections as it contributes, even if indirectly, to the setting of the rules governing the electoral process, whether these rules or principles are of a constitutional or legal nature. That is from one angle and from another, it pays attention to its correctness and declares its results.\nIn fully understand this matter, we have examined the scope of the Constitutional Council's intervention in relation to establishing the rules governing presidential elections by reference to the 1996 Constitution and Organic Law (12.01), concerning the electoral system. We have also examined the extent of its contribution to the integrity of the presidential elections and the announcement of their results.\nThis abstract translated by Dar AlMandumah Inc. 2018

|d Le conseil constitutionnel est l’une des institutions constitutionnelles les plus importantes en Algérie, car il est doté de spécificités qui lui permettent de jouer un rôle majeur dans le processus électoral, et en particulier dans les élections présidentielles. Il contribue d’une façon indirecte à l'élaboration des règles qui régissent le processus électoral d’une part, et d’autre part il veille à la régularité de l'élection et à la proclamation des résultats Pour cerner le sujet nous avons abordé à la marge de manoeuvre du conseil constitutionnel dans l’élaboration des lois régissant les élections présidentielles en se référant à la constitution de 1996 et la loi organique 12-011relatives au régime électoral

|a يعتبر المجلس الدستوري من بين أهم المؤسسات الدستورية في الجزائر، إذ يتمتع باختصاصات هامة جعلته يحتل هذه المكانة لاسيما في المجال الانتخابي، وعلى وجه الخصوص في الانتخابات الرئاسية، إذ يساهم ولو بطريقة غير مباشرة في وضع القواعد المنظمة للعملية الانتخابية سواء كانت هذه القواعد ذات طبيعة دستورية أو قانونية هذا من جهة، ومن جهة أخرى يسهر على صحتها ويعلن نتائجها. \\ ومن أجل الإحاطة بهذا الموضوع تطرقنا الى نطاق تدخل المجلس الدستوري في وضع القواعد المنظمة للانتخابات الرئاسية بالرجوع لدستور 1996 والقانون العضوي 12-01 المتعلق بنظام الانتخابات، والبحث في مدى مساهمته في نزاهة الانتخابات الرئاسية وإعلان نتائجها.
