|a إن هذا البحث مهم ويقتضيه واقع العراق المضطرب الذي يدور فيه جدل حاد حول إنشاء الأقاليم وما تثيره من مخاوف متعددة وآراء مختلفة من حيث مشروعيته أو عدمها في نظر الإسلام، لذلك حاولت في هذا البحث المتواضع أن أبين حكمه الشرعي، وذلك من خلال بحث كل الجوانب والأصول والثوابت المتعلقة به، والنظر في الأدلة وأقوال الفقهاء والنصوص القانونية التي تتحدث عن الإقليم وحقوقه وصلاحياته وعلاقته بالدولة المركزية، ومعطيات الواقع العراقي وما هو عليه من ظروف وأحوال سياسية واجتماعية وأمنية استثنائية، ومألات إنشاء الأقاليم في ظل هذه المعطيات والظروف من مصالح ومفاسد ومنافع وأضرار، ومن ثم بيان الحكم الشرعي لإنشاء الأقاليم بصورة حيادية وأسس علمية.

|b The research of (The decision to establish the territory for itself and others within the framework of the legal constants related to the entity of the nation and its societies) is important and contradicted by the troubled reality of Iraq .There is great debate about establishment the territories in Iraq. Its raises multiple concerns .There are views differ in terms of its legality or not from the point of view of Islam. So I tried in this humble search explain its legal ruling, and that is through by examining all aspects, assets, and constants that related to it. And look at the evidence and sayings of scholars and facts of the Iraqi reality and its exceptional circumstances of political, social and security conditions .The results of establishment of the provinces in the light of these facts and circumstances. We are must study the interests, benefits, losses and the resulting consequences then give the legitimate authority to establish the territories impartially.
