| 520 | |a يتطلب إبرام العقد الإداري إتباع جملة من الإجراءات القانونية التي أشارت إليها تعليمات تنفيذ العقود الحكومية رقم (1) لسنة 2008م المعدلة والتعليمات الأخرى النافذة والإعلان عن المناقصة هو أحد الإجراءات المطلوب إتباعها من قبل جهة التعاقد لغرض إبرام العقد المراد تنفيذه من قبل الإدارة والذي يهدف من خلاله إعلام المخاطبين من المهتمين بموضوع العقد برغبة الإدارة في إبرام العقد وبالتالي فأنه يحتاج إلى وسائل معينة لنشره في الصحف اليومية واسعة الانتشار والموقع الإلكتروني ولوحة الإعلانات في جهة التعاقد بالإضافة إلى إمكانية النشر في وسائل الإعلام الأخرى كالتلفزيون والراديو حسب أهمية العقد وتقدير جهة التعاقد، وتكمن أهمية الإعلان في أن بعض الراغبين في التعاقد قد لا يعلموا بحاجة الإدارة إلى تنفيذ عقد معين إلا من خلال الإعلان عنه كما انه يحول بين قصر الإدارة عقودها على طائفة معينة من الأشخاص بحجة انهم وحدهم الذين تقدموا بالإضافة إلى الإعلان يعطي الراغبين بالتعاقد فرص متساوية في تقديم كلفة المشروع موضوع العقد ونوع الخدمات المواد تقديمها وشروطها مما يؤدي إلى تحقيق المبادئ الرئيسة التي تقوم عليها إجراءات المناقصة. و أن كافة الشروط والبيانات التي يجب أن يتضمنها الإعلان ملزمة فيتعن على جهة التعاقد احترامها عند الإعلان من حيث المدد وكيفية إجرائه وعدد مراته والا ترتب على ذلك بطلان المناقصة كما في حالة اذا لم تحترم الإدارة المدد المقررة للإعلان أو اذا لم تسلم لاحد المتقدمين الشروط الكاملة للمناقصة، وقد يحدث أن يعاد إعلان المناقصة بسبب عدم تقديم الشركات عطاءاتها خلال مدة المحدودة لتقديمها أو تقديم عطاء واحد فقط خلال مدة تقديم العطاءات إلا أنه في حالة تقديم أكثر من عطاء وكان واحداً منها مقبولاً فنياً وتجارياً فأنه يتم قبوله والسير بإجراءات تحليل وتقويم العطاء و الإحالة حسب الصلاحيات المالية المخولة لرئيس جهة التعاقد. كما يجب مراعات الإجراءات معينة عند إعادة الإعلان عن المناقصة منها استحصال موافقة رئيس جهة التعاقد أو من يخوله على إعادة الإعلان وتحديد مدة الإعلان وإبلاغ المناقصين المشاركين في المناقصة والجهات المعنية بذلك والتحري عن أسباب عدم المشاركة واعتماد ذات التسلسل للمناقصة إذا كان إعادة الإعلان في نفس السنة. | ||
