|a قياسا علي نص المادة 69 من القانون المدني يمكن اعتبار حكم رسو المزاد على أنه عقد بيع يتم بتلاقي الإيجاب المتمثل في العطاء المقدم من أحد المزايدين مع القبول المتمثل في رسو المزاد، غير أن الاجتهاد القضائي قد سار في اتجاه مغاير واعتبره قرار ولائي صادر في شكل حكم قضائي يجوز الطعن فيه بموجب دعوى البطلان.\nوالواقع أن حكم رسو المزاد يشبه الأحكام القضائية الأخرى من حيث الشكل، أما عن موضوعه فهو يتضمن عملية بيع تتم بالمزايدة بغرض تسديد الديون المتعلقة في ذمة المدين، ومن أجل ذلك لا يمكن الطعن فيه بطرق الطعن العادية وغير العادية، بل يجوز الطعن فيه بالبطلان بدعوى أصلية أمام المحكمة موقح العقار مع مراعاة شهرها تحت طائلة عدم قبولها شكلا تطبيقا لنص المادتين 17 و519 من قانون الإجراءات المدنية والإدارية.\n
