|a قررت سلطة الاستيلاء الإداري بجوار نزع الملكية لتتمكن الإدارة من الاستيلاء مؤقتا على ما يلزمها من أملاك الأفراد الخاصة باجراء أسهل وأيسر من إجراءات نزع الملكية، لسهولة هذه الطريقة غالبا ما تحاول الادارة أن تلجأ إليها لتتفادى نزع الملكية نظرا لما يستلزمه من إجراءات بطيئة ومعقدة. لكن قاضي الأمور المستعجلة يقف للإدارة بالمرصاد في هذا المجال كلما تبين أن الاستيلاء المؤقت غير مشروع ويحل محل نزع الملكية، فله سلطة تقديرية واسعة للأمر بوقف تنفيذ قرار الاستيلاء إذا توفرت الشروط، إلى حين إلغائه من طرف قاضي الموضوع إذا ثبت عدم مشروعيته.
