المستخلص: يعد موضوع مصادر القانون الإداري من الموضوعات الكلاسيكية التي تدخل ضمن المبادئ العامة للقانون الإداري فبالإضافة إلى كل من التشريع والعرف، كان للقضاء فضل كبير في الكشف عن قواعد هذا القانون في بلد المنشأ وهو ما يتأكد مما تناوله الفقه الإداري بخصوص هذا الموضوع. لكن تعد تلك النظرة الفقهية قاصرة في معالجة ذلك الموضوع - أي المصادر- لأن البحث فيه أعمق من ذلك بكثير لا سيما في الجزائر، لذلك أردت إماطة اللثام عن مصدر آخر يبدو للوهلة الأولى جد تقليدي في بعض القوانين الأخرى، إلا أن الوضع يختلف تماما عندما يتعلق الأمر بمبادئ الشريعة الإسلامية كمصدر للقانون الإداري من خلال إثبات الأساس التشريعي، وهذا هو مضمون الدراسة.

The subject of the sources of administrative law is one of the standard subject we study in relation to the general principles of administrative law. In addition to the legislative and customary sources, the case law has played a primary role in the elaboration of this field of law in its source country. However the vision of the classical doctrine of the sources in administrative law does not seem comprehensive in its approach to this topic in the Algerian context as it is necessary to uncover another source that is rather of a purely historic interest in some countries, that of Islamic law. Doing so will require another approach to the theory of sources in administrative law. The focus of my research is defining this new approach.

Le sujet des sources du droit administratif est un sujet classique qui fait partie des principes généraux du droit administratif. En plus des sources législatives et coutumières, la jurisprudence a joué un rôle de premier plan dans l’élaboration de ce droit dans son pays d’origine. Cependant la vision de la doctrine classique concernant les sources du droit administratif ne nous semble pas suffisante dans son approche surtout dans le contexte algérien. Nous voulons lever le voile sur une autre source qui semble à première vue très traditionnelle dans la constitution des lois du droit musulman. Cependant la prise en considération de cette source, sous la forme de principes généraux du droit introduit des éléments exigeant une autre approche à la théorie des sources en droit administratif. C’est cette approche que j’entends clarifier dans cette étude.
