The interrogation is at the forefront of the criminal case. En effet l’interrogatoire procure à l’accusé l’un des droits les plus importants qui est le droit de défense, ce qui a porté le législateur algérien à instaurer des règles et garanties a respecter obligatoirement sous peine de nullité de la procédure de l’instruction préparatoire. يحتل الإستجواب مكان الصدارة في الدعوى الجنائية، ويرجع ذلك للدور الكبير الذي يقوم به في مرحلة التحقيق الابتدائي، بإعتباره الاجراء الوحيد الذي يأخذ فيه المنهم صفة إيجابية تتيح له مشاركة فعالة بالنسبة لكل ما يجري بشأنه، حيث ترتب له أهم الحقوق وهو حق الدفاع والذي يفوق ما يرتبه عليه الإتهام من أهمية. وهذا ما دعا المشرع إلى إحاطته بجملة من القواعد والضمانات يتعين مراعاتها تحت طائلة البطلان. |
