المستخلص: Algeria is one of the countries that rely heavily on public spending policies to reflect its development programmes. Therefore, it pays special attention to the legislation governing the operation and exploitation of public funds. One of the important laws in this context is the regulation of public transactions, which has become known for many amendments, especially in recent years. The most recent was the issuance of Presidential Decree No. 15-247, which regulates public transactions and authorizations of the public service, which brought a new vision based on the protection of past gains and strengthens the strategy of balancing public funds protection as well as achieving maximum efficiency in responding to public demands. The aim of this study is to address the new procedures in terms of how to conclude them as the first and most important stage in the solicitation of proposals.

L'Algérie est parmi les pays qui comptent beaucoup sur la politique des dépenses publiques et ce pour le bien d’exécution des programmes de développement , et a cette effet , elle accorde une attention très particulière aux législations qui régissant le fonctionnement des fonds public, et peut-être l'un des lois les plus importantes dans ce contexte, on trouve le code des marché public, qui est devenu connu par trop de modifications et notamment au cours des dernières années, où il a été plus récemment constaté l'émission du décret présidentiel n ° 15-247 portant réglementation des marchés publics et des délégations de service public , qui porte une nouvelle vision basée sur la protection des gains précédents , et d'assurer l’efficacité de la commande publique , Par conséquent, cette étude vise à répondre aux nouvelles procédures qui concerne le mode de passation au marché publics , la première étape obtenir les offres

تعد الجزائر من بين الدول التي تعتمد على سياسة الإنفاق العمومي بشكل كبير، وهذا في سبيل تجسيد برامجها التنموية، لذلك فهي تعطي اهتماما خاصاً للتشريعات التي تحكم تسيير واستغلال المال العام، ولعل من بين القوانين الهامة في هذا الإطار نجد تنظيم الصفقات العمومية، الذي أصبح يعرف العديد من التعديلات خاصة في السنوات الأخيرة، حيث كان آخرها صدور المرسوم الرئاسي رقم 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام، والذي جاء برؤية جديدة تقوم على حماية المكتسبات السابقة، وتعزز من إستراتيجية الموازنة بين حماية المال العام وكذا تحقيق أكبر قدر من النجاعة في الاستجابة للطلبات العمومية، وعليه تهدف هذه الدراسة إلى التطرق إلى جديد هذه الإجراءات فيما يخص كيفية الإبرام على اعتبار أنها أول وأهم مرحلة في استدراج العروض.
