|f The main purpose of economic criminal law is to combat offences committed against the country's economic policy. As a result, although it can be seen that economic criminal legislation in some respects complies with traditional criminal law, it is nevertheless possible to note that several differences may be noted. The specificity of the economic offence consists in the complexity of its concept, which is fundamentally related to the various economic regulations of each state. The material element is characterized by ambiguity and extensibility, so the moral element has a certain setback. |d Le but essentiel du droit pénal économique est la lutte contre les infractions commises à l’encontre de la politique économique du pays. De ce fait, même si l’on peut constater que sur certains points la législation pénale économique est conforme à la législation pénale classique, Il n’en demeure pas moins que plusieurs divergences peuvent être relevées. La spécificité de l’infraction économique consiste en la complexité de sa notion qui revient fondamentalement aux régulations économiques variées de chaque état. L’élément matériel se caractérise par l’ambigüité et l’extensibilité, ainsi l’élément moral connait un certain recul. De même, il faut relever que l’infraction économique contrairement aux règles classiques du droit pénal peut être imputable non seulement aux personnes physiques coupables mais également aux personnes morales, voir à des cas de responsabilité pénale du fait d’autrui.\nL’infraction pénale a des conséquences négatives sur le plan économique, social et politique. Il est donc essentiel de lutter contre cette infraction crime.

|a إنّ الهدف الأساسي لقانون العقوبات الاقتصادي هو قمع الجرائم المرتكبة ضد السياسة الاقتصادية للدّولة. وعلى الرغم من وجود العديد من النّقاط المشتركة بين القانون الجنائي العام والقانون الجنائي الاقتصادي، إلا أن الجريمة الاقتصادية لها خصوصيات تميزها عن الجريمة العادية. ونلمح هذه الخصوصية من خلال تعقيد مفهومها، الذي يرجع أساسا إلى اختلاف الأنظمة الاقتصادية لكل دولة. كذلك يتسم الركن المادي لهذه الجريمة بالاتساع و الغموض ، كما نلمس تقليص الركن المعنوي، وكذا توسع نطاق المسؤولية لتشمل مسؤولية الأشخاص المعنوية والمسؤولية عن فعل الغير.\nو للجريمة الاقتصادية آثار سلبية كبيرة سواء على المستوى الاقتصادي، الاجتماعي، أو السياسي، لهذا لابد من مواجهتها والتّصدي لها
