|a إن حق الدفاع أمام هيئات القضاء الجنائي هو أهم الحقوق الطبيعية القديمة قدم الإنسان والذي يتمتع بحماية من التشريعات الأساسية الداخلية ومن المواثيق والمعاهدات الدولية، يتمتع به الإنسان بغض النظر عن الاتهام الموجه له وهو يمثل الحاجز المنيع من استبداد السلطة، وهو حق عام يتمتع به المواطن كما يتمتع به الأجنبي، بل هو أحد مقومات العدالة الجنائية التي لا تقوم إلا بتوافره، لأنه إذا كان من حق المجتمع ألا يفلت مذنب من العقاب فإنه من غير العدل أن يحكم ظلما وافتراء عن برئ وهو ما نادت به الشريعة الإسلامية منذ عقود طويلة

|b The right of defense before the criminal courts is the most important of the ancient natural rights, which benefits from the protection of the fundamental national legislation and the conventions and external international treaties which benefit the humans whatever the accusation against him, which represents a guarantee against the abuse of power, it is a general right enjoyed by the citizen as well as abroad, one of the elements of criminal justice, because if society has the right to punishment,it is unfair to unfairly judge an innocent person.

|d Le droit de la défense devant les juridictions pénales est le plus important des droits naturels anciens, qui bénéficie de la protection de la législation nationale fondamentale et les conventions et les traités internationaux externes dont bénéficient les humains quelle que soit l'accusation portée contre lui, ce qui représente une garantie contre l’abus de pouvoir, un droit général dont jouit le citoyen ainsi que l'étranger, l'un des éléments de la justice pénale, parce que si la société a le droit au châtiment, il est injuste de juger injustement 'un innocent.
