المستخلص: إن حق الإنسان في الحياة وفي سلامة وتكامل جسده مكفول قانونا، وحتى لا تخرج الاستفادة من مزايا نقل الأعضاء من الأموات إلى الأحياء عن دائرة المشروعية تبرز أهمية التطرق للضوابط القانونية لهذه العملية، وقد نظم المشرع الجزائري مبكرا موضوع زراعة الأعضاء البشرية في قانون حماية الصحة وترقيتها والذي تضمن شروطا تفصيلية لنقل الأعضاء وزراعتها من الأموات إلى الأحياء يمكن تقسيمها إلى شروط عامة وأخرى خاصة، حيث يفترض أن يكون الهدف منها تشجيع نقل وزراعة الأعضاء البشرية انطلاقا من الحتمية الطبية، ولكن في إطار المشروعية القانونية التي يضمن من خلالها تلافي محاذير العملية وما قد ترتبه من نتائج سلبية غير مقبولة لا شرعا ولا طبا ولا قانونا.

The human right to life and his body’s integrity and safety is legally guaranteed;so as not to take benefits of the advantages of moving organs from the dead to the living on the legitimacy;the importance of addressing the legal control of this process stands out. Therfor the Algerian legislator prearrange the human organ transplantation in the protection and promotion of health act which contained detailed conditions to transfer and transplant organ from the dead to the living. This can be devided into general and special so it is assumed that the aim from it to encourage the transfer and transplant of human organs based on medical determinism but within the frame of legal legitimacy from which avoid process caveats is guaranted and what may have negative consequences that is not accepted religiously nor medically or legally.

Le droit de la vie et l'intégrité et la sécurité de corps human sont légalement garantis, afin de ne pas profiter des avantages illégaux du transfert des organes des morts aux vivants, cela montre l'importance d’étudier les contrôles légaux de ce processus. Le législateur algérien prévoit alors la transplantation d'organes humains dans la loi de la protection et la promotion de la santé, qui contient des conditions détaillées pour le transfert et la transplantation d'organes des morts vers les vivants, on suppose que son but est d'encourager le transfert et la transplantation d'organes humains en raison de la nécessité médicale, mais dans le cadre de la légitimité juridique, pour éviter les avertissements et les conséquences négatives qui ne sont pas acceptées religieusement, médicalement et légalment.
