|a تعتبر مسألة نقل الاختصاص القضائي في الجرائم الإرهابية، أحد أهم الآليات الإجرائية التي تبنتها اتفاقات التعاون القضائي والأمني في إطار مجلس التعاون الخليجي، والجامعة العربية، بهدف التغلب على مشكلة تنازع الاختصاص القضائي بين الدول المتعاقدة وبالشكل الذي يزيد من إمكانية تنفيذ الأحكام الجنائية في الجرائم الإرهابية، حيث وضعت جملة من الضوابط الموضوعية والإجرائية يمكن بمقتضاها أن يؤول الاختصاص لمحكمة الدولة التي يوجد فيها المتهم ، وقد حاولت تذليل الصعوبات العملية التي تواجه إنفاذ القانون خارج نطاق الدولة وهو ما تتطلب تطويعا حادا لبعض النصوص الإجرائية بمقتضى القانون الاتفاقي، والذي يسعى لفرض سيطرته العقابية ومنع الجاني من الإفلات من العقاب من ناحية ووفقا لمقتضيات المحاكمة العادلة من ناحية أخرى .

|d La question du transfert de compétence dans les crimes terroristes est l'un des mécanismes procéduraux les plus importants adoptés par le CCG et la Ligue arabe pour résoudre le problème des conflits de compétence entre les États contractés et accroître la possibilité d'exécuter des jugements pénaux dans des crimes terroristes. Ces derniers ont établie un ensemble de contrôles de fond et de procédure par lesquels la compétence pouvait être accordée au tribunal de l'État dans lequel se trouvait l'accusé et surmonter les difficultés pratiques de l'application de la loi extraterritoriale.
