على الرغم من الدور الايجابي الذي تمارسه الوسائل التقنية، فأنها لا تخلو من السلبيات ولعل أبرزها ظهور مجموعة من الجرائم التي تختلف باختلاف المجال الذي ترتكب فيه كالتجسس وإتلاف المعلومات، فضلاً عن السرقة وإجراء التحويلات المصرفية بطرق غير مشروعه وذلك باستخدام الوسائل الحديثة للاتصال، ومن ضمن المجالات التي تستخدم فيه استخدامها في ارتكاب الجرائم المخلة بالآداب والأخلاق العامة التي تتخذ عدة صور منها إشاعة الفاحشة عن طريق إنشاء موقع أو نشر معلومات مخلة بالآداب العامة. وتمثل جرائم تقنية المعلومات سلوك غير مشروع موجه نحو إساءة استعمال النظام الآلي لمعالجة المعلومات باستخدام الحاسوب أو أية وسيلة تقنية، وأن تحديد طبيعتها القانونية لا يمكن أن تتم وفق القواعد التقليدي، إذ يذهب أغلب الفقهاء نحو عدم قابلية النصوص القائمة أو عجزها للانطباق على الأنماط الجديدة من الجرائم. إذ أن النصوص العامة في التشريعات الجنائية والتي تخضع لها جريمة إنشاء موقع أو نشر معلومات مخلة بالآداب العامة بواسطة وسائل تقنية المعلومات غير كافية، ولا سيما أنها تحمل سمات تجعلها تتطلب معالجة خاصة من حيث التجريم والعقاب. إذ أن عدم وجود قانون خاص يعالج الجرائم التقنية يؤدي إلى إعطاء القاضي سلطة واسعة في تفسير القواعد العامة مما قد يخل بشرعية الجرائم والعقوبات، إضافة إلى أن العقوبة غير كافية قياساً بخطورة السلوك وطبيعته وجسامة الجريمة. الأمر الذي يستدعي تدخل المشروع الجنائي لتشريع قانون خاص لمعالجة أحكام هذه الجرائم. وأن إيجاد حماية تشريعية ملائمة من إساءة استخدام تلك الأجهزة يعد خير وسيلة لضمان مصالح الأفراد، فضلاً عن ضمان استمرار التقدم العلمي وازدهاره، بما يضمن التوازن بين مصلحة الأفراد في الاستعانة بهذه التقنية ومصلحتهم في حماية الآداب والأخلاق العامة من إساءة استخدامها.
