المستخلص: Range of actualization Unfair Competition in a Copyright The fair and unfair competition is actualize in the area of industrial ownership rights like patent and trademark which is one branch of intellectual property, for a long time ago, it had been settled that an author is not a merchant when he do his activities in writing for that the commercial law rules is not applied in his work, and authors did various activities regardless of the rules of the Commercial Code. The technological development have changed the means of expression of thoughts, especially the development in communication and social networks and the change of knowledge transfer means from using books, magazines, and journals to electronic journals and book through internet technology. In addition to that the emergence of literary and scientific websites, and electronic media and huge spread of knowledge through the internet, and the spread of collective works that preserve the copyright to publishing houses and translations centers which become big companies because of large volume of publications which was the main reason for growth of their revenues. The study aimed to answer the following questions: is it allowed to change what previously settled about the activities of the author? And, is it possible to witness unfair competition in copyrights? And, is the author a trader where he can be involved in fair and unfair competitions. The study discussed the findings from the previous literatures on this subject and explains the perspectives of scholars about the legislation of copyright law in Iraq and Arabic countries which have close legislative approach to Iraq. In addition to that the researcher conducted a critical review to the legislative and judicial reality in United States because it is the pioneer in this field. The study recommended that all decision makers, legislators, judges, and specialists in law to read the findings of this study before making any amendments to the current laws associated with copyright.

تتحقق المنافسة المشروعة وغير المشروعة في نطاق حقوق الملكية الصناعية أو المحل التجاري باعتبارهما المجال المباشر لممارساتها، واستقر ومنذ زمن طويل أن قيام المؤلف بنشاطه لا يمثل عملا يخضع لقواعد القانون التجاري، لكن في ظل التقدم التكنولوجي في وسائل التعبير والاتصال والتواصل الاجتماعي، وتحول الإنسانية من نشر ونقل المعرفة بواسطة القرطاس والقلم والكتب والمجلات التقليدية إلى الكتب والمجلات الإلكترونية والتداول الرقمي للمعلومات بمختلف أنواعها وصنوفها، وظهور المواقع الأدبية والعلمية والإعلامية والإخبارية على شبكة الإنترنيت، وانتشار المصنفات الجماعية التي تعود حقوق التأليف فيها إلى شركات التأليف والترجمة والنشر، التي أصبحت من الشركات العملاقة بفضل ما ينتجه عملها الأدبي من مردود مالي كبير فهل يباح لنا الأن تغيير ما استقر سابقا بصدد نشاط المؤلف، والإجابة عن سؤال يثيره ما تقدم من تطور وتغيير في نمط الحياة الإنسانية، مفاده هل يمكن أن تحدث منافسة غير مشروعة فى حق المؤلف؟ وبكلمة أخرى هل يعد المؤلف تاجر ليمارس أو تمارس ضده منافسة تجارية مشروعة أو غير مشروعة؟ ولتقديم إجابة ملائمة عن هذا السؤال، فقد حاولنا تسليط الضوء على هذا الموضوع وبينا أراء الفقه وموقف التشريع والقضاء في العراق وفي الدول العربية المقاربة للمنهج التشريعي العراقي، وكذلك قمنا بمقاربة للواقع التشريعي والقضائي في الولايات المتحدة الأمريكية لما لها سبق الخوض في هذا المجال المهم، وانتهينا بالتوصية إلى أصحاب القرار من مشرعين وقضاة ومختصين بضرورة ملاحظة نتائج هذا البحث المتواضع عند تقديم معالجات تشريعية أو تنفيذية أو نظر قضايا تخص حق المؤلف.
