The TRIPS agreement came with the principle of priority and national treatment to be practically enforced to eliminate borders between member countries; it expanded the range of protection through these principles to cover the citizens of non-member countries who are residents in countries members in the agreement; and included a set of exceptions on these principles which conform providing unified protection of copyright and art protection in light of applying these exceptions. While the objective of TRIPS agreement was to enhance protection measures among member countries and apply its principles and objectives to internationally promote the value of intellectual property, TRIPS included the headlines of protection of copyrights and neighboring rights, regarding the preferences to stipulations of Rome and Bern agreements, and that enforcing these principles was enough to rule with practically marginalizing the legal value of these principles, and result in negative impacts on adopting a unified protection for these rights in light of these exceptions of the agreement. It is obvious that TRIPS agreement committed all its member states to provide legal protection not less than that provided to its citizens, to enforce its principles and acknowledgement of equality among the citizens of member states; as the legislations of the member states included texts regarding these principles in light of the fast and continuous technological development of cloning methods, and the increased need for the continuation of cultural exchange among states. This agreement showed the importance of neighboring rights, in addition to author's copyright for its importance in publishing author's production through performers, Audio-¬recording producers. Radio organizations, and providing full protection for these organizations. The agreement showed the mechanism of protection of authors of digital literature and art works in the advanced countries upon using these works in the developing countries through enforcing the principles of the agreement, in a way that guarantees the literature and financial rights of authors, and the need of developing countries for these digital works to develop and exchange cultures between the citizens of member states.
إن اتفاقية تربس جاءت بمبدأ المعاملة الوطنية ومبدأ الدولة الأولـى بالرعايـة لإعمالها من الناحية العملية، ولإزالة الحواجز بين الدول الأعضاء، حيث وسعت نطاق الحماية من خلال هذه المبادئ ليشمل رعايا الدول غير الأعضاء المقيمين على أراضي دولة عضو في الاتفاقية. وأهداف اتفاقية تربس توطيد معايير الحماية فيما بين البلدان الأعضاء وتطبيق مبادئها وأهدافها للرفع من قيمة الحقوق الفكرية على المستوى الدولي حيث إن اتفاقية تربس تضمنت الخطوط العريضة في مجال حماية الحقوق الأدبية والحقوق المجاورة، ويبدو واضحا أن اتفاقية تربس ألزمت كل المنتمين إليها من الدول الأعضاء بتوفير حماية قانونية لا تقل عن تلك التي توفرها للمواطنين، إيمانا بأعمال مبادئها وإقرار المساواة بين رعايا الدول الأعضاء، حيث إن التشريعات القانونية للدول الأعضاء تضمنت نصوصا حول هذه المبادئ في ضوء التطور التقني السريع المستمر لوسائل الاستنساخ، وتزايد الحاجة إلى استمرار التبادلات الثقافية بين البلدان، وأظهرت هذه الاتفاقية أهمية الحقوق المجاورة بجانب حق المؤلف لما لها من أهمية في نشر ما ينتجه المؤلف من خلال المؤدين ومنتجي التسجيلات الصوتية وهيئات الإذاعة وتوفير الحماية الكاملة لهذه الهيئات. وأظهرت الاتفاقية آلية الحماية لمؤلفي المصنفات الأدبية والفنية في الدول المتقدمة عند استعمال المصنفات في الدول النامية من خلال إعمال مبادئ الاتفاقية بما يكفل الحقوق الأدبية والمالية للمؤلفين، وحاجة الدول النامية لهذه المصنفات لتطوير الثقافات وتبادلها بين رعايا دول الاتفاقية.
