|a تعتبر مسألة التصرف في أموال الأيتام من أهم المسائل الفقهية الواقعية التي يحتاج المجتمع الفلسطيني إلى بيان أحكامها، وذلك بسبب ازدياد أعداد الشهداء نتيجة الحروب العدوانية الإسرائيلية المستمرة على أبناء شعبنا، لذلك جاء هذا البحث الموسوم بـ: (مضاربة الولي لنفسه في مال اليتيم)، ليعالج هذه القضية المهمة من خلال بيان مفهوم المضاربة، وأركانها، وشروطها، ثم الكشف عن طبيعة سلطة الولي على مال اليتيم، وما مدى مشروعية مضاربته في هذا المال لنفسه، وما هي المقاصد الشرعية التي يحققها الولي في مضاربته بمال اليتيم على القول بجوازها، ثم ينتهي الباحث ببيان الضوابط الشرعية التي تكفل حفظ أموال اليتامى وتنميتها بعيدا عن جشع الأولياء وأطماعهم.

|b The issue of using the orphans' wealth is considered among the most important practical issues in Fiqh that is needed to be clarified in the Palestinian society. This is due to the increasing numbers of martyrs as a result of the continuing Israeli wars and attacks against the Palestinian people. In this context, this study titled “Practicing Mudarabah by the guardian, Wali, for himself in the orphan’s wealth” aims to address this issue through clarifying the concept of Mudarabah, its pillars, and conditions. This is followed by clarifying the nature of the Wali's authority in the orphan’s wealth, and to which extent this Wali has the right to use this wealth in the practice of Mudarabah for his own benefit. The study also presents the Islamic objectives that the Wali may achieve through this practice assuming that it is a permissible one. The study concludes by clarifying the Islamic criteria to develop orphans’ funds and protect them from the greed and desires of their Wallis.
