المستخلص: تحقيق المناط هو إحدى ركائز الاجتهاد الفقهي، فهو يرفد المجتهد بالمنهج العلمي السليم الذي يجب أن يسلكه في سبيل التنزيل الصحيح للأحكام الشرعية على وقائعها العملية المناسبة. وهو لا يتم بطريقة آلية، بل لابد أن يستند إلى فقه بالواقع العملي الذي ستطبق عليه هذه الأحكام. ويتأكد هذا أكثر في عصرنا الذي كثرت فيه النوازل وتجددت فيه الوقائع القديمة بصور مختلفة بفعل ما يحتف بها من ملابسات مستجدة.

Tahqiq ul-Manat (verifying the reality) is one of the pillars of juristic Ijtihad (deduction of rulings). It provides the Mujtahid (scholar) with the sound knowledge-based methodology which he must follow in the way of the correct application of Shar’iah rulings upon their appropriate practical realities. It does not occur in a mechanical manner but rather must be based upon understanding the practical reality which these rulings will be applied upon. This is reiterated more in our current age in which many issues have arisen and old realities have been renewed in different forms due to what has surrounded them in terms of newly occurring circumstances or conditions.

La présence de la cause représente un pélier principale des péliers de l’effort de la juridiction puis qu’il offre au la borieux la méthodologie scientifique qui doit la suivre dans le but de projecter les décréts juridiques sur les faits et leurs parties correspondantes, et il ne se posse pas de manière automatique mais il nécessite une juridiction profonde à la réalité sur la quelle sont s’appliquer ces décrets et particulièrement de nos jours ou les nouveautés s’ont en augmentation et les faits anciens se sont transformés en d’autres modernes l’entourent et cela à partir de la vision du dieu.
