This article deals with the importance and necessity of benefiting from the Nawazil (Contemporary issues jurisprudence) of the book Al-Me'yar Al-Marab wa Al-Jam'e Al-Maghrib 'an Fatawa Ahle Ifriqiyah wa Al-Andalush wa Almaghrib by Abu Al-Abbas Ahmad ibn Yahya al-Wonshreisi (may Allah have mercy on him) in our contemporary life in general and financial in particular, and an explanation of the methodology followed in that as one of the most important books in terms of scientific value in the Fiqh of Al-Nawazil among the Maalikis Fuqahah, to include a rich and modern jurisprudence, which is linked to the adoption of known evidentiary rules such as the Qur'an, Sunnah, Ijmāʿ (consensus) and qiyās (deductive analogy)... And mix it with the evidence of the Ijtihad of Maalikis. This article focused on financial transactions as the broadest field of Ijtihad (independent reasoning), renewable, and most sensitive to people's necessities and needs as Money is the cornerstone of life and the basis for achieving comprehensive and sustainable development. This abstract translated by Dar AlMandumah Inc. 2018 يتناول هذا المقال الحديث عن أهمية وضرورة الاستفادة من نوازل كتاب المعيار المعرب والجامع المغرب عن فتاوى أهل أفريقية والأندلس والمغرب لأبي العباس أحمد بن يحيى الونشريسي رحمه الله في حياتنا المعاصرة عموما والمالية خصوصا، وبيان المنهج المتبع في ذلك، باعتباره من أهم الكتب من حيث القيمة العلمية في فن النوازل عند فقهاء المالكية، لتضمنه مادة فقهية دسمة ومتجددة، مؤصل لها بالجمع بين اعتماد الأصول الاستدلالية المعروفة كالكتاب والسنة والإجماع والقياس... ومزجها بأدلة الاجتهاد الخاصة بفقهاء المالكية، ولقد ركز هذا المقال في الجانب التطبيقي على المعاملات المالية باعتبارها أوسع المجالات اجتهادا، كما أن لها قابلية للتجديد وأكثرها مراعاة لضرورات الناس وحاجاتهم، إذ المال عصب الحياة وأساس تحقيق التنمية الشاملة والمستدامة. Cette présente recherche tente de mettre la lumière sur l’importance et la nécessité de profiter des cataclysmes du livre exprimé la norme encyclopédiste arabe à-propos de avis consultatif «FATWAS» pour les peuples d’Afrique et de l’Andalousie et le Maroc d’Abu al-abbas ahmed ben yahia al-wancharissi (la grâce de dieu) dans notre vie contemporaine, et une déclaration pour l’approche adoptée pour cela, comme l’un des livres les plus importants en termes de valeur scientifique dans l’art des cataclysmes des savants, en mettant l’accent sur le côté pratique des transaction financières considérés comme les plus larges domaines de diligence, susceptibles d’être renouveler, en tenant compte les besoin de la plupart des personnes. |
