المستخلص: Cette contribution se propose dřexaminer, par des exemples concrets, le phénomène du «plagiat » dans la traduction juridique en Algérie. Mais pourquoi peut-on parler de «plagiat » dans la traduction des textes juridiques algériens Ŕ législatifs en particuliers ? Et puis sous quelles formes se manifeste-t-il ? En effet, le «plagiat» dans la traduction juridique se présente sur deux plans : conceptuel et linguistique. Sur le plan conceptuel, nous notons lřemprunt de plusieurs notions juridiques à la législation française, à lřinstar de «loi organique», «garde à vue», «droit commun», «éligibilité», «incompatibilité des mandats», …etc. Du point de vue linguistique, le plagiat se révèle essentiellement dans le calque stylistique ainsi que dans la traduction servile. Ainsi, le plagiat nřest pas uniquement dans lřappropriation illégitime de travaux ou dřidées attribués à dřautres personnes. Il est partout et possède plusieurs figures.

This contribution will examine, with concrete examples, the phenomenon of "plagiarism" in legal translation in Algeria. But why can we speak of "plagiarism" in the translation of Algerian legal texts - Legislative in particular? And in what form does it manifest? Indeed, the "plagiarism" in legal translation is presented on two levels: conceptual and linguistic. Conceptually, we note the loan of several legal concepts to French legislation. In linguistic terms, plagiarism essentially reveals in stylistic loan and in servile translation. Thus, plagiarism does not only occur in the misappropriation of ideas or works assigned to other people, it is everywhere and has several figures.
