المستخلص: تعد الترجمة القانونية من أصعب أنواع التراجم لارتباطها الوثيق بالقانون ولغته التي تمتاز بالدقة إذ تمتلك خصائص نحوية وأسلوبية ومفرداتية ودلالية خاصة على غرار اللغات العلمية الأخرى كلغة الطب والفيزياء والكيمياء الخ. ولكن ما يميز اللغة القانونية عن اللغات الأخرى هو استخدامها لمفردات لها معنى محدد وخصائص دلالية تختلف عن اللغة المستخدمة في الحياة اليومية، فبعض الكلمات لها معنى مختلف عن المعنى المعروف في اللغة العامة أو قد يختلف معناها ضمن السياق القانوني المستخدم وعلى اختلاف فروع القانون. فضلا عن أن بعض الكلمات قد لا تكون مستخدمة في اللغة الخاصة وقد ينحصر استخدامها في لغة القانون مما يشكل عائقا أمام المترجم في فهم النصوص القانونية وترجمتها. ومن المشكلات والصعوبات الأخرى التي يتعرض لها المترجم القانوني هي تعددية الأنظمة القانونية، إذ لكل نظام خصائص معينة تتحدد ضمن الإطار الاجتماعي والثقافي لمجتمع أو بلد ما. لذا، على المترجم أن يكون خبيرا في كلا المجالين (اللغوي والقانوني) ليتسنى له ترجمة النصوص القانونية.

Legal translation is amongst the most difficult types of translation because it is relevant to the Law and its own language. Legal language is distinguished by its usage of lexis carrying specific meaning and semantic features different from every day’s language, some meanings of words varies according to the legal context by which they are used or in terms of the branches of the Law. In addition, usage of some words is confined, only to the legal language, that is considered as obstacle in understanding and translating of legal texts by the translator. Among other problems and difficulties, is the diversity of the legal systems; each system has its own specific characteristics within a social and cultural framework of a society or a country. The legal translator must therefore have a double knowledge (linguistic and legal) to be able to translate legal texts.

La traduction juridique est un type particulier et assez complexe de traduction spécialisée car elle est étroitement liée au droit et sa langue qui possède des caractéristiques sémantiques, stylistiques, syntaxiques et lexicales qui lui sont propres. La langue juridique est une langue particulière. Elle se distingue d’autre langue de spécialités (la langue médicale, par exemple) par l’emploie des termes polysémiques. De plus, la signification d’un terme juridique pourrait être différente de sa signification courante. Il est à signaler que certains termes sont exclusivement juridiques et ne sont pas employés dans la langue courante, tels que les termes archaïques et les termes empruntés à d’autres langues juridiques, ce qui constitue un obstacle à la compréhension et la traduction des textes juridiques. Par ailleurs, le traducteur juridique se heurte à un autre obstacle majeur, qui est celui de la diversité des cultures et des systèmes juridiques en présence ; chaque système juridique se détermine selon le cadre social et culturel d’une société ou d’un pays donné. Le traducteur juridique doit avoir donc une double connaissance (linguistique et juridique) pour pouvoir traduire des textes juridiques.
