يتضح أن النظام الفيدرالي لم يطبق في العراق ولم يتم ذكره ألا في حقبة الاحتلال الأمريكي للعراق عام 2003 كونه الأسلوب الأمثل لتحقيق السياسة الأمريكية في العراق. فيما يتعلق بالنظام الفيدرالي المقترح تطبيقه بالعراق فإن أهم ما يؤخذ عليه أنه لم يكن نابعاً من حاجة ورغبة الشعب العراقي أنما جاء نتيجة القوى السياسية المعارضة عندما كانت خارج السلطة وبرعاية أمريكية والتي أكدت ضرورة بناء عراق فيدرالي يخدم مصالحهم في العراق، وقد أقر ذلك في عام 1999، ثم جاء مؤتمر برلين 2002 والمؤتمرات اللاحقة للمعارضة لتكريس هذا المطلب، حتى أقر بعد الاحتلال الأمريكي للعراق بموجب الدستور الدائم عام 2005 وبما أن الفيدرالية ليست مواد قانونية تكتب وتفرض على الشعب وإنما هي ثقافة سياسية ووعي من الولاء المزدوج لدولة الاتحاد والإقليم، وأن الشعب العراقي يفتقر لهذا نوع من الثقافة السياسية بعد غياب من الديمقراطية تجاوز خمسة وأربعين عام (كون العراق غادر الديمقراطية منذ العام 1958) كان الولاء فيها قائم على أساس شعب واحد وطن واحد وقائد واحد، فكيف له أن يفهم طبيعة الولاء المزدوج لكل من الإقليم والاتحاد وهذا مأخذ أخر على الديمقراطية في العراقية. ومن الأجدر في الوقت الراهن اتباع النظام اللامركزية ومن ثم التحاور بين كل الأطراف لتشكيل الفدرالية العراقية المنسجمة مع طبيعة ومكوناته، فضلا عن دراسة التجارب الأخرى للاستفادة من أخطائها وتلافيها ومن ثم خلق نظام خاص قد يحتذي به المجتمعات العربية الأخرى.
