|a نتيجة للتطور التكنولوجي في مجال المعلومات والاتصالات فلقد ترك ذلك التطور فراغا تشريعيا وقفت إمامه النصوص القانونية عاجزة عن احتواء ما استجد منها من انتهاكات واضحة لحق الإنسان في الخصوصية من خلال مراقبة المكالمات الهاتفية وإلكترونية باستخدام أجهزة التنصت والتسجيل مما يشكل قيدا على خصوصية الإنسان وهو الأمر الذي يحطم التوازن بين الحرية الشخصية وتنفيذ القانون فلا يجوز مطلقا تسجيل المكالمات التليفونية والإلكترونية التي تعد أسلوبا من الأساليب الحياة الخاصة للناس إلا في الحدود التي ينص عليها القانون، لذا من الضروري إيجاد المصلحة العامة التي هي الغاية الأسمى. ويهدف البحث إلى عرض دراسة تحليلية للنصوص الدستورية والدولية والقانونية المنظمة لحق الإنسان في حماية سرية مكالماته الهاتفية والإلكترونية في ظل تزايد مخاطر اقتحام خصوصية الإنسان باستخدام أجهزة التنصت والتسجيل الحديثة وأثارها السلبية ومدى التجاوز عليها من قبل الأفراد والسلطات العامة باستخدام الأجهزة الإلكترونية الحديثة في ظل ثورة الاتصالات والمعلومات.

The research aims to present an analytical study of constitutional and international legal texts of the Organization of the human right to secret telephone calls and electronic protection in the light of the increasing risk of breaking into human privacy using bugging devices and modern recording and their negative effects and the extent of overtaking them by individuals and public authorities by using modern electronic devices under the communications and information revolution.
