L'attention de la Justice transitionnelle est apparue lopesque les états qui sont sorite d'un régime dictatorial ou des conflits communautaires affrontaient des difficultés de instaurer d'un régime démocratique efficace. En effet, on ne peut pas imaginer un régime démocratique efficace sans conduire des procédures sans remédier les victimes et poursuivre les criminelles. La fonction fondamentale de la justice transitionnelle est que c'est comme un lien entre l'époque de la souffrance d'un peuple et entre d'un régime démocratique qui reflète ses ambitions. Cela ne se réalise qu'après rééquilibrer les droits de l'homme et mettre en évidence la notion de la citoyenneté. Pour cette raison, cette notion occupe une grande importance dans le cas Irakienne après 2003 et le changement radicale après cette année au niveaux des recherches et des conférences. Mais les politiciens Irakiennes ne lui ont pas donné cette importance qui peut répondre les problèmes de la société Irakienne, bien que la constitution de 2005 indiquait à cette notions dans nombreux ce ses dispositions. Pour cela, on essaie mettre la lumière à cette notion et ses buts selon le cat Irakien pour diagnostiquer les obstacles que entraves son adoption pour mettre en route la Justice transitionnelle qui conduirais à appliquer un régime démocratique efficace. برز الاهتمام بمفهوم العدالة الانتقالية عندما واجهت الدولة الخارجة من نظام دكتاتوري او من عنف مجتمعي داخلي صعوبة كبيرة في ارساء النظام الديموقراطي. حيث لا يمكن تصور ترسيخ أي نظام ديمقراطي مباشرة دون تفعيل اجراءات محددة لإنصاف الضحايا ومحاسبة المسؤولين عن جرائم محددة. فان وظيفة العدالة الانتقالية تتمثل في كونها حركة الوصل حقبة المعاناة التي تعرض لها شعب معين وبين نظام ديمقراطي فعال يلبي طموح هذا الشعب. ولا يمكن تفعيل ذلك الا عبر اعادة التوازن على صعيد الحقوق والواجبات وإبراز دور المواطنة. ولذلك احتل موضوع العدالة الانتقالية أهمية كبيرة في الحالة العراقية بعد عام 2003 والتغير الراديكالي الذي حدث بعد هذا العام. الا ان الساسة العراقيون في الحقبة لم يولوا للعدالة الانتقالية أهمية كبيرة ترقى الى مستوى المشاكل التي عانى منها هذا البلد بالرغم ان الدستور العراقي قد أشار في كثير من نصوصه الى خطوات ينبغي تنبيها لتفعيل العدالة الانتقالية. ولذلك حاولنا ابراز مفهوم العدالة الانتقالية وأهدافها وفقا للحالة العراقية وتشخيص المعوقات التي اكتنفت تطبيقها في سبيل تجاوزها من اجل الحث مرة اخرى الى إعادة التفكير بضرورة تطبيق العدالة الانتقالية التي لا زالت مطلبا منطقا لدفع النظام الديمقراطي الى الامام. Interest in the concept of transitional justice emerged when the country emerging from a dictatorial regime or internal societal violence faced great difficulty in establishing a democratic system. It is inconceivable to entrench any democratic system directly without activating specific procedures for providing victims with justice and holding those responsible for specific crimes accountable. The function of transitional justice is to be the link to the era of suffering suffered by a particular people and to an effective democratic system that meets the aspirations of the people. This can be done only by rebalancing rights and duties and highlighting the role of citizenship. The issue of transitional justice was, therefore of great importance in the post-2003 Iraqi situation and the radical change that took place after this year. However, Iraqi politicians of the era did not attach much importance to transitional justice to the problems faced by the country, despite the fact that the Iraqi Constitution referred in many of its texts to steps that should be alerted to the activation of transitional justice. Therefore, we have tried to highlight the concept of transitional justice and its objectives in accordance with the Iraqi situation and to diagnose the obstacles that have been encountered in order to overcome them in order to urge once again the rethinking of the necessity of implementing transitional justice, which remains a logical requirement to move the democratic system forward.
