المستخلص: Cet article vise à analyser l’apport du Protocole contre le trafic illicite de migrants par terre, air et mer, additionnel à la Convention des Nations Unies contre la criminalité transnationale organisée, et sa compatibilité avec les principes internationaux relatifs aux droits de l'homme en matière de protection de la dignité de la personne et des droits humains des migrants illégaux. En effet, si ce Protocole se veut être une référence en matière de lutte contre le trafic illicite de migrants, une analyse approfondie de ses articles révèle une prédominance de la protection de la souveraineté de l’Etat au dépend de la protection des migrants irréguliers, bien que la responsabilité pénale de ces derniers soit écartée dans ledit Protocole. Ce dernier point est d’autant plus important que des Etats, bien qu’ils aient ratifié le Protocole, continuent d’incriminer ces migrants. La réalité des migrations illégales est plus complexe que le Protocole ne l'indique. Notre étude sera effectuée sur la base d’une analyse globale des principes apportés par le protocole relatif au trafic de migrants et leur adéquation aux différentes règles et normes internationales relatives aux droits de l'homme dans un contexte de lutte contre le trafic illicite de migrants sur fond de criminalité transnationale organisée.

The purpose of this article is to examine the contribution of the Protocol against the smuggling of migrants by land, sea and air, additional to the United Nations Convention against transnational organized crime, and its compatibility with international human rights principles in term of protection of the dignity of the person and the human rights of illegal migrants. Indeed, if this Protocol aims to be a reference in the fight against the smuggling of migrants, a thorough analysis of its articles reveals a predominance of the protection of the State's sovereignty at the expense of the protection of irregular migrants, although the criminal responsibility of the latter is excluded in the said Protocol. This last point is all the more important as States, although they have ratified the Protocol, they continue to incriminate these migrants. The reality of illegal migration is more complex than the Protocol indicates. Our study will be conducted on the basis of a global analysis of the principles of the Migrant Smuggling Protocol and their relevance to different international human rights standards and norms in the context of combating the smuggling of migrants against a backdrop fight of transnational organized crime.
