المستخلص: تناول البحث موضوعا فقهيا ذا أهمية كبيرة وخطورة بالغة في واقعنا المعاصر، وعنوانه: تغرير الممارس الصحي بالمريض "دراسة فقهية مقارنة". وجاءت هذه الدراسة: إثر تزايد بعض الممارسات الخاطئة في المجال الطبي، وتعمد بعض الممارسين الصحيين استغلال حاجة المريض، من خلال التغرير به، وحمله على إجراء عمل طبي لا مصلحة له فيه بوسائل كاذبة ومضللة؛ طمعا في الكسب المادي. وهي تهدف إلى: بيان الحكم الشرعي في هذا الجانب، وتفصيل أحكامه، وتوضيح الآثار المترتبة عليه، خاصة مع دقة مسائله، وتنوع صوره، وحاجة الناس إلى معرفة أحكامه. وقد خلصت في نهايتها إلى: أن الأدلة الشرعية تتفق مع الأنظمة الوضعية المحلية والعالمية في وجوب الصدق مع المريض، والنصح له، ومراعاة مصلحته، معتبرة أن ممارسة التغرير في المجال الطبي خيانة للمريض، وإساءة لمهنة الطب الشريفة، وأنه إذا تسبب التغرير المتعمد في الإضرار بالمريض فإن الممارس الصحي الغار يكون مرتكبا لجناية عمدية توجب عليه القصاص. وتوصي هذه الدراسة: بأن على الحاكم أو من يقوم مقامه أن يتخذ من الإجراءات ويسن من الأنظمة ما يحد من تفشي هذه الممارسات التي تسيء إلى مهنة الطب، وتنزع الثقة بين أفراد المجتمع.

This research deals with an important, wide and extremly dangerous topic on Jurisprudence which is :patient deception by health practitioners a comparative jurisprudence study. It is considered a vital jurisprudential subject and a severe issue plaguing the modern day and age. Among the reasons to discuss the topic, there remains a central theme presented in this study and that is the growing number of medical malfeasance practices as well as the deliberate exploitation of the patient's need through unscrupulous means. Unfortunately, patients are tricked into authorizing medical work in which he/she has no interest or need by false and misleading means for material gains. This study aims to clarify the Sharia ruling on the matter, detailing its rulings, and explaining the effects which results from it, especially with its tricky issues, and different faces. The research concluded with results that : the sharia evidence agrees with the local and International regulation systems in being honset with the patient, ofering advice and considering his/her best interest. Furthermore, Sharia law considers any form of defraudingin the medical field as a betrayal of the patient, an abuse of the medical profession. And when a deleberate deception causes harm to the patient by the health practitioner he/she is considered to commit a delebarate crime and thus faces Qisaas (a retributive justice). The study recommends legislative bodies to pursue legal actions and enact regulations to limit the cancerous spread of practices that harm the profession of medicine and shake societal confidence
