المستخلص: The Algerian legislator has regulated the transplantation of humanorgans and imposed on them the restrictions and preconditions to which the doctorsfollowingthem must comply, in addition to having to obtain the consent of the donorunder the conditions laid down by the law of health. Anyaggressionagainst a member of the living humanbeing to beextractedwithouthis consent and without the existence of legal conditions exposes the offender to criminalliability, in orderto protect the human right to hissafety and the integrity of his body.

لقد نظم المشرع الجزائري مسألة نقل وزرع الأعضاء البشرية وأحاطها بقيود وشروط مسبقة، يجب على الأطباء الذين يجرونها التقيد بها، بالإضافة إلى ضرورة الحصول على موافقة المتنازل وفق للشروط المنصوص عليها في قانون حماية الصحة، وكل اعتداء على عضو من أعضاء الإنسان الحي بالانتزاع دون موافقته ودون توفر الشروط القانونية يعرض الفاعل للمسؤولية الجنائية، وذلك لحماية حق الإنسان في سلامته وسلامة جسده.

Le législateur algérien a réglementé la transplantation des organes humains et leur a imposé des restrictions et conditions préalables auxquelles doivent se conformer les médecins qui les suivent, en plus de besoin d'obtenir le consentement du donneur dans les conditions prévues par la loi de la santé. Toute agression contre un membre de l'être humain vivant à extraire sans son consentement et sans l'existence de conditions légales expose le délinquant à la responsabilité pénale, afin de protéger le droit de l'homme à son sécurité et à l'intégrité de son corps.
