|b Divorce may take place in a state of anger and impulsivity, and may be issued without the thought, discretion and perception of the consequences of the divorce and the consequent damages. In the text of Article 50, the wording needs to be amended and scrutinized, so as to clarify the provisions of divorce retroactive, because of its practical importance and impact on the family.

|a قد يقع الطلاق في حالة غضب واندفاع، وقد يصدر بدون تدبر وترو وتصور لعاقبة الطلاق وما يترتب عليه من الأضرار، لذا شرع الله تعالى الرجعة للحياة الزوجية، من خلال الطلاق الرجعي، الذي لم ينص عليه المشرع الجزائري صراحة في قانون الأسرة، إنما أشار إلى المراجعة في نص المادة 50 بصياغة تحتاج إلى التعديل والتدقيق، لتتوضح أحكام الطلاق الرجعي، لما له من أهمية عملية وأثر على الأسرة.

|d Le divorce peut se produire sans la pensée, la discrétion et la perception des conséquences du divorce et du préjudice qui en résulte: Dieu a initié la réaction à la vie conjugale, par le divorce réactionnaire, non explicitement affirmé par le législateur algérien dans le droit de la famille. Mais renvoyé à la révision dans le texte de l'article 50 dans le libellé qui doit être modifié et examiné, de clarifier les dispositions du divorce rètroactive.
