المستخلص: En règle générale, un patient blessé par une erreur médicale doit prouver l'erreur du médecin selon les règles générales, mais le patient a des difficultés à élever ce fardeau, d'autant plus que le travail médical est caractérisé par des travaux techniques incompréhensibles. Et des mécanismes qui allègeraient son fardeau.
Ainsi, cet article traite de la façon de prouver l'erreur médicale, en déterminant quelle est l'erreur médicale et la déclaration de ses avantages et sur qui doit prouver l'erreur médicale afin de prendre la main du patient et la réparation du dommage causé.

لكي يحصل المريض المضرور على تعويض جراء الضرر الذي لحقه نتيجة الخطأ الطبي، عليه أن يأتي بدليل قاطع على هذا الخطأ باعتباره المكلف بعبء الإثبات كمبدأ عام، غير أن المريض يواجه صعوبات خلال النهوض بهذا العبء، لا سيما وأن الأعمال الطبية تمتاز بكونها أعمال فنية لا يفهمها الشخص العادي أو المريض، مما يجدر بنا البحث عن حلول وآليات من شأنها التخفيف من حدة تحمله لهذا العبء.
وعلى هذا فإن هذه الورقة تتناول كيفية إثبات الخطأ الطبي، من خلال تحديد ما هو الخطأ الطبي وبيان مميزاته وعلى من يقع إثبات الخطأ الطبي حتى يتم الأخذ بيد المريض وجبر الضرر الذي لحقه.

In order for the injured patient to receive compensation for the damage suffered as a result of the medical error, he must provide conclusive evidence of this error, as he is charged with the burden of proof as a general principle. However, the patient faces difficulties in carrying out this burden, especially since medical work is distinguished by being a technical for of work which is not understood by the average person or the patient. It is therefore worth looking for solutions and mechanisms to alleviate the burden.
As such, this paper deals with how to prove a medical error, by defining the medical error and explaining its specificities, and by identifying upon whom is the burden to prove the medical error, so that the patient can be guided and reparation can be made for the damage suffered.
