Environment is deemed the first long range victim of armed conflicts, whereas the international society gives this common framework more importance because of risks which threaten its integrity, especially in the era of the anarchical use of technologies during belligerences; however scholars knowledge the positive contribution presented by international treaties to enhance the protection of environment during armed conflicts. Among the obstacles, which stand in the way of the entire application of these conventions, we mention the question about criteria on which the consideration of damages is based on; and the issue of conditions required to establishing the international responsibility even civil or criminal.
