المستخلص: Le présent travail est une étude comparative qui tente à mettre en exergue un exposé des jugements relatif à la paroi commune suivant plusieurs volets. Le premier met l'accent sur le système juridique de la paroi commune limitant deux pays dans le cadre du droit des relations civiles des Émirats Arabes Unis et celui du droit public libyen. Le second volet concerne les jugements de la paroi commune dans les deux systèmes. Cette étude essaye de définir le concept de la paroi commune et précise les obligations du propriétaire de cette dernière en termes d'usage, de dépenses, de grenier et ses exigences. Le dernier moment avait comme objet la question juridique de la paroi séparative de deux bâtiments, et non un joint, et ce mur a des dispositions particulières en matière d'utilisation et d'obligations du propriétaire de la paroi séparative.

This research attempts to carry out a comparative study of the provisions of the common wall in several topics. The first is to explain the legal system of the common wall in the two countries through the law of civil transactions in the United Arab Emirates and the Libyan Civil Code. The second is the provisions of the common wall in the two systems, and the study includes the definition of the common wall, the obligations of the owner of the wall in terms of use, expenses and the cause and their conditions; The third topic is devoted to the study of the provisions of the wall, that is separating two buildings rather than being common. This wall has special provisions in terms of use and the obligations of the owner of the separate wall. There are several points in this topic.

يحاول هذا البحث القيام بدراسة مقارنة لأحكام الحائط المشترك في عدة مطالب، الأول بيان النظام القانوني للحائط المشترك في البلدين من خلال قانون المعاملات المدنية الإماراتي والقانون المدني الليبي، والثاني أحكام الحائط المشترك في النظامين، وتشمل الدراسة تعريف الحائط المشترك، والتزامات مالك الحائط من حيث الاستعمال والنفقات والعلية وشروطها، أما المطلب الثالث فقد خصص لدراسة أحكام الحائط الفاصل بين بنائين وليس مشتركا، وهذا الحائط له أحكام خاصة من حيث الاستعمال والتزامات مالك الحائط المنفصل، مع تقسيم هذه المطالب إلى فقرات.
