المستخلص: La politique d'économie du marché envisagée par l'état Algérien et la consécration du principe de la liberté de production et d'importation ont entrainé la libre circulation des produits et services, ce qui fait du marché algérien un marché tourné beaucoup plus vers l'importation et consacre une économie de bazar.
L'Algérie est un pays qui importe plus qui' il ne produit, tout est fait pour qu'aucun produit ne manque sur le marché. Il faut admettre, que certains produits importés causent au consommateurs des préjudices énormes, parce qu'ils ne sont pas conformes aux normes algériennes.
Pour palier à cette insuffisance, le législateur impose à l'importateur l'obligation de conformité et d'accepter un contrôle au niveau des frontières avant de mettre le produit sur le marché. Le contrôle est visuel et en cas de doute soumettre le produit à des examens approfondis avant d'autorises sa mise sur le marché.
A cet effet le législateur a ordonné aux inspections chargées de contrôle de refuser la mise de tout produit non conforme sur le marché et d'entreprendre des diverses mesures en cas de violation de cette obligation.


The Algerian State's policy of economic openness and the establishment of the principle of freedom of production and import has allowed for the free exchange of products in particular and services in general. It has also made Algerian markets empty containers for various foreign products. Especially when we know that Algeria is more an importing country than a producer. This massive quantity of products has brought prosperity to the Algerian consumer by providing him with every necessary and luxurious thing. He acquires it, sometimes without discernment of the serious damage that it might cause if it did not comply with legal specifications.
In order to protect the security and safety of the consumer, the legislator has placed on the importer an obligation to comply. To embody this commitment, he has established at the level of various borders authorities charged with consumer protection, i.e. the fraud enforcement agents who ensure that imported products conform to legal specifications and international standards. This is done by subjecting them to different tests, such as general and in-depth examination and resorting to deducting samples for analysis in approved laboratories for that reason before putting them on the market. These regulatory bodies are also given different powers in case of proof of lack of conformity.

إن سياسة الانفتاح الاقتصادي التي انتهجتها الدولة الجزائرية وتكريس مبدأ حرية الإنتاج والاستيراد، سمح بحرية تبادل المنتوجات بصفة خاصة والخدمات بصفة عامة، وأدى أيضا إلى جعل الأسواق الجزائرية حاويات ومفارغ لمختلف المنتوجات الأجنبية، وبخاصة إذا علمنا أن الجزائر هي بلد مستورد أكثر منه منتج. فإن كان هذا الكم الهائل من المنتوجات قد حقق رفاهية للمستهلك الجزائري بتوفير له كل ما هو ضروري وكمالي، إذ إنه يقدم على اقتنائها دون أن يتفطن أحيانا إلى الأضرار الجسيمة التي قد تلحق به إذا كانت غير مطابقة للمواصفات القانونية.
حرصا من المشرع على حماية أمن وسلامة المستهلك، ألقى على عاتق المستورد التزاما بالمطابقة. وتجسيدا لهذا الالتزام أنشأ على مستوى الحدود المختلفة أجهزة مكلفة بحماية المستهلك أي أعوان قمع الغش تسهر على التأكد من مطابقة المنتوجات المستوردة للمواصفات القانونية والمقاييس الدولية وذلك بإخضاعها إلى مختلف كالفحص المجرد والمعمق واللجوء إلى الاقتطاع عينات قصد تحليلها في المخابر المعتمدة لذلك هذا قبل طرحها في السوق، كما خول لهذه الأجهزة الرقابية، صلاحيات مختلفة في حالة إثبات عدم المطابقة.
