|d Le présent document traitera avec analyse, quelques articles de la loi n° 06-01 en faisant ressortir les différents types de corruptions dans le secteur public que la présente loi avait promulgués, sans être criminalisés dans le code pénal.\nCes différents types de corruptions se résument essentiellement dans :\nla Corruption des Fonctionnaires publics étrangers et des Fonctionnaires d'organisations internationales.\nl'abus de fonctions\nl'enrichissement illicite\nl'acceptation des cadeaux\nEn se basant essentiellement sur les articles 28, 33, 37, 38 de la présente loi 06-01, l'intervenant a essayé de mettre en exergue les crimes précités et de les analyser, faisant apparaître au mieux la définition du fonctionnaire public et son extension par rapport à ce qui a été promulgué antérieurement dans la loi portant code pénale.\nA cela s'ajoute l'élargissement de cette loi (loi 06-01), de culpabilité qui compte dans quelques cas les fonctionnaires publics étrangers et les Fonctionnaires d'organisations internationales.\n

|a يتناول هذا المقال بالتحليل بعض مواد القانون رقم: 06-01 محاولا الكشف عن صور الرشوة في القطاع العمومي التي استحدثها هذا القانون، والتي لم تكن مجرمة بموجب قانون العقوبات، وتتمثل هذه الصور إجمالا في:\n-\tرشوة الموظفين العموميين الأجانب وموظفي المنظمات الدولية.\n-\tإساءة استغلال الوظيفة.\n-\tالإثراء غير المشروع.\n-\tتلقي الهدايا.\nوبالاعتماد أساسا على المواد: 28، 33، 37، 38 من القانون رقم: 06-01 حاول البحث تبين أركان الجرائم المذكورة وتحليلها، فاتضح انضباط مفهوم الموظف العمومي واتساعه مقارنة بما جاء في قانون العقوبات، هذا إضافة على توسيع هذا القانون (أي القانون 06-01) لصفة الجاني لتشمل في بعض الجرائم الموظفين العموميين الأجانب وموظفي المنظمات الدولية.\n

|f This article analyses some articles of Act No. 01 – 06 , in an attempt to uncover the forms of bribery in the public sector introduced by this law, which were not criminalized under the Penal Code. In general, these images are as follows:\n- Bribing foreign public officials and officials of international organizations.\n- Abuse of position.\n- Illicit enrichment.\n- Receiving gifts.\nBased mainly on articles 28, 33, 37 and 38 of Act No. 01 - 06, the research sought to identify and analyse the elements of the crimes mentioned. It was clear that the concept of a public official was disciplined and broad in comparison with the provisions of the Penal Code, in addition to the expansion of the Penal Code (Act No. 01 - 06) as an offender to include in some offence foreign public officials and officials of international organizations.\nThis abstract translated by Dar AlMandumah Inc 2018.
