|a إن كان المشرع يملك صلاحية تنظيم الزواج من خلال تحديد سن أدنى لهذا العقد، بهدف القضاء على ظاهرة الزواج المبكر وآثاره السلبية، وضمانا لاستقرار عقود الزواج وحماية للقصر.\nونظراً لعدم قدرة الزوجين قبل هذه السن غالبا على الوفاء بالالتزامات المترتبة على الزواج في إطار العلاقات الأسرية والإنسانية، لاسيما في ظل التحولات الاقتصادية، الاجتماعية والثقافية التي يشهدها المجتمع الجزائري في الوقت الراهن.\nفإنه ينبغي أن يمارس هذه الصلاحية في إطارها المشروع دون أن يستعملها كذريعة لإسقاط ما يرتبط بها من أحكام أو لانتهاك حرية الزواج بشكل أو بآخر.

|d Si le legislateur a le pouvoir de réglementer le mariage, en fixant un âge minimum pour ce contrat afin d'éliminer le phénomène du mariage précoce et ses effets négatifs et assurer la stabilité du mariage et la protection des mineurs.\nEn raison de l'impuissance du couple avant cet âge souvent d’exécuter les obligations du mariage dans le contexte de la famille et les relations humaines, notamment que la société algérienne connaître actuellement des changements économiques et socioculturelles.\nIl devrait exercer ce pouvoir dans le cadre licite sans être utilisé comme un prétexte pour éliminer les dispositions engagées ou de violer la liberté du mariage d'une façon ou d'une autre.
