المستخلص: La question de la terminologie est "une question fondamentale dans la traduction spécialisée", car le terme est "le nerf du texte juridique", la raison de l’intelligibilité de son sens et la lisibilité de son contenu. Mais le terme juridique en Algérie vit dans un contexte particulier et complexe, ce qui a généré un certain nombre de problèmes qui ont influencé sur sa formation, sa traduction et sa compréhension. Il est donc important de traiter la problématique de la formation du terme juridique algérien, ou plutôt sa traduction, en tenant compte de la combinaison linguistique juridique (Français /Arabe), de la grande mobilité qui en résulte sur le marché de la traduction juridique et des exigences des services gouvernementaux et des administrations locales.

The question of terminology is "a fundamental question in specialized translation" because the term is "the nerve of the legal text", the reason for the intelligibility of its meaning and the readability of its content. But the legal term in Algeria lives in a particular and complex context, which has generated a number of problems that have influenced its formation, translation and understanding. It is therefore important to deal with the problem of the formation of the Algerian legal term, or rather its translation, taking into account the legal linguistic combination (French / Arabic), the great mobility that results in the market of legal translation and requirements of government departments and local administrations.

تعد قضية المصطلحات "قضية أساسية في الترجمة التخصصية"، بل إن المصطلح هو "عصب النص القانوني"، وعلة استقامة معناه وجلاء مضمونة، لكن المصطلح القانوني بالجزائر يحيا في سياق خاص ومعقد، مما ولد جملة من الإشكالات أثرت على وضعه وترجمته وفهمه على حد سواء. ومن هنا، تتجلي أهمية التطرق إلى إشكالية وضع المصطلح القانوني الجزائري، أو بالأحرى ترجمته، في ظل الازدواجية المتنامية للغة القانون بين الفرنسية والعربية وما يتمخض عنها من حركية كبيرة في سوق الترجمة القانونية ومتطلبات المصالح الحكومية والإدارة المحلية.
