المستخلص: تطور المبادلات الإلكترونية أفرز اليوم العديد من الإشكالات القانونية التي تواجه نظام الملكية الفكرية عموما وحق المؤلف خصوصا، والتي تبرز على عديد من المستويات، أبرزها ظهور مصنفات حديثة لم تكن موجودة سابقا أو ما اصطلح عليه "المصنف الرقمي" بالإضافة إلى خلق عدة صعوبات متصلة ببعض الأحكام القانونية في ظل القواعد التقليدية .
وهذا ما ستحاول الدراسة توضيحه من خلال تبيان الإطار القانوني لحماية حق المؤلف ومن ثم أهم آثار المبادلات الإلكترونية عليه من ظهور مصنفات رقمية وصعوبات قانونية مرتبطة بصفة أصلية بها.

L’évolution des échanges numériques a fait paraitre de nouvelles problématiques auxquelles le droit de propriété intellectuelle, et en particulier le droit d’auteur, font face aujourd’hui. En effet, ces échanges semblent avoir contribué à déstabiliser l’équilibre sur lequel reposait, jusqu’alors, la législation sur le droit d’auteur au point de la mettre en difficulté et susciter sa remise en cause.
La présente étude essaye d’identifier et d’analyser les effets ainsi que les implications juridiques des échanges et des œuvres numériques sur le droit d’auteur dans toutes ses composantes.

The development of electronic exchanges has today created many legal problems faced by intellectual property system in general and copyright in particular, which stand out on many levels. Most notably are the emergence of modern works or what is termed as “digital works” that did not exist previously, in addition to creating several difficulties concerning with some legal provisions under the traditional rules.
This is what the study will attempt to explain by clarifying the legal framework for copyright protection and hence the main effects of the electronic exchanges on it, such as the emergence of digital works and legal difficulties associated with them.
