المستخلص: The patent is one of the most important industrial property rights and one of the most detrimental to commercial and economic relations. Therefore, countries have sought to provide an effective legal framework that protects inventions and preserves the rights of their owners through patents. It also allows States to benefit from technological and technical developments in all fields. The TRIPS (Trade-Related Aspects of Intellectual Property Rights) Convention laid the foundations for protection by defining the scope of patented inventions and those exempted from them. It also enumerated the rights of patent holders and the cases where the patent holder was forced to grant a licence to exploit it under the compulsory licensing system, which is the greatest restriction on the exclusive right of the patent holder.

Le brevet d’invention est le plus important des droit de la propriété industrielle ; vu son impact sur les relations commerciales et économiques , ce qui a incité les pays a trouver un cadre juridique efficace contre tout dépassement , afin de protéger les inventions , et préserver les droits de ses propriétaires, et enfin permettre aux états de bénéficier des avancées technologiques ; et pour se faire il a fallu mettre en place un cadre juridique efficace qui n’est autre que la TRIPS, qui constitue aujourd’hui un texte de base pour la protection des brevets d’inventions sur le plan international tant qu’elle contient des dispositions qui régissent le champ d’application des droits du propriétaire du brevet ,et les exceptions qui y succombent notamment pour ce qui est des autorisations obligatoires.

تعد براءة الاختراع من أهم حقوق الملكية الصناعية ومن أكثرها مساسا بالعلاقات التجارية والاقتصادية، لذا سعت الدول إلى توفير إطار قانوني فعال يحمي الاختراعات ويحفظ حقوق مالكيها عن طريق براءة الاختراع، كما يسمح للدول بالاستفادة من التطورات التكنولوجية التقنية في جميع المجالات، فوضعت اتفاقية التريبس الأسس التي تقوم عليها الحماية من خلال تحديد نطاق الاختراعات المحمية بموجب براءة الاختراع، وتلك المستثناة منها، كما عددت حقوق أصحاب البراءة وحالات إجبار صاحب البراءة على منح الترخيص باستغلالها وفق نظام التراخيص الإجبارية التي تعد أكبر قيد على الحق الاستئثاري لصاحب براءة الاختراع.
