The family is the basic cell of society and maintaining it, and the collapse of the morals of society has led to an augmentation in family disintegration. And falls within the latter an increasing of outrageous between relatives, which is a crime known as incest, leading to the inevitability of state intervention in some private family affairs, in order to indorse justice and good morals as well as return the usurped rights between relatives. Therefore, we find that the protection of family is not only limited to family law, but also extended to the Penal Code, which in turn provides legal protection to the family, a case that applies to incest, a crime of sexual nature, which its perpetrators are of blood or affinity association. Thus, the Algerian legislature has provided for this criminal act, with the availability of its elements, direct and indirect legal protection due to the importance of incest system, incriminating the infringement of this system abiding by the Islamic law, and that is done by ordering deterrent penalties to anyone who is tempted to commit this heinous crime.
تعد الأسرة هي الخلية الأساسية لبناء المجتمع والمحافظة عليه، وأمام انهيار أخلاق المجتمع، أدى هذا إلى تفاقم حالات التفكك الأسري، ويندرج ضمن هذا الأخير ازدياد الفاحشة بين الأقرباء، وهذا ما يعرف بجريمة الفحش بين ذوي المحارم، مما دفع إلى حتمية تدخل الدولة في بعض الشؤون الخاصة بالأسرة، من أجل رفع الظلم وإقرار الأخلاق الحميدة وإرجاع الحقوق المسلوبة بين الأقارب، لذلك نجد أن حماية الأسرة لا تقتصر على قانون الأسرة فحسب، بل تتعداه إلى قانون العقوبات، الذي بدوره يوفر حماية جنائية للأسرة، وهي الحال التي تنطبق على جريمة الفحش بين ذوي المحارم، ذات الصبغة الجنسية، وتربط بين مرتكبيها رابطة الدم أو المصاهرة، فقد وفر المشرع الجزائري لهذا الفعل المجرم بتوافر عناصره، حماية جنائية مباشرة وغير مباشرة وذلك لأهمية نظام المحارم، مجرما التعدي على هذا النظام على منوال الشريعة الإسلامية، وذلك بترتيب عقوبات ردعية إلى كل من تسول له نفسه ارتكاب هذه الجريمة الشنعاء.
