المستخلص: يركز هذا البحث على بيان وتقييم مسار الفحص والدراسة التمهيدية التي يجريها مكتب المدعية العامة للمحكمة الجنائية الدولية حول الوضع في فلسطين، وذلك بعد مرور ثلاث أعوام تقريبا على بدء الشروع فيها، فمرور هذه المدة الزمنية ساهمت في تنامي شكوك لدى الضحايا الفلسطينيون، والمختصون، بإمكانية انتقال لخطوة أخرى أكثر جدوى، خاصة في ظل الإشكاليات القانونية التي تحكم هذا المسار، من حيث عدم خضوعه لإطار زمني محدد، وعدم القدرة الفلسطينية للتراجع عنه، ما يجعل الأمر أكثر إلحاحا على الفلسطينيين لفحص الخيارات المتاحة بما في ذلك أهمية بناء استراتيجية تشاركية ترتكز على تجويد العمل القانوني الفلسطيني لتحركات متعددة من بينها إمداد مكتب المدعية العامة بالمزيد من المعلومات بصورة شهرية، أو التحرك بموجب المادة 14 من نظام وما الأساسي، بوصفها دولة طرفا فيه، أن تحيل "وضعا" دون اختيار حالات محددة، فضلا عن التحرك في المساحات الأخرى وخاصة جمعية الدول الأعضاء على نظام روما، والتحالفات غير الحكومية الدولية المعنية بالعدالة الجنائية الدولية.

This study focuses on the preliminary study by the Office of the Prosecutor of the International Criminal Court on the Palestinian situation, on the occasion of Three years from start initiating, over this period of time contributed to a growing sense of doubts among Palestinians victims, and specialists, about the possibility of transmission to another meaningful step, especially under legal problems governing this path, where as its not subject to a specific timeframe, and the inability of Palestinian to retreat, where there is opportunities to finish it without access to the beginning of a judicial investigation in criminal court, which makes it even more urgent for Palestinians to examine the available options including the importance of building a participatory strategy based on optimizing the Palestinian legal work of multiple movements including giving the Office of the Prosecutor more information on a monthly basis, And/or to move under article 14 of Rome Statute, as a State party in it, to transmit "situation" without choosing specific cases, as well as special move on other areas specially the Assembly of State Parties to the Rome Statute, and international non-governmental alliances concerned in international justice.
