المستخلص: La confiance et la sécurité fournis aux opérateurs par internet sont les premières garanties pour la prospérité des relations électroniques ; ce qui exige la création des nouveaux dispositifs neutres qui prennent en charge la protection des données réciproques entre les opérateurs. La question qui se pose ici c’est quels sont les dispositifs créés par les législations étrangères et celle de l’Algérie pour fournir ses informations, et quelle est la nature des obligations exigées pour un environnement électronique paisible pour les relations par internet. Le législateur a actualisé à la loi 04-15 ce qu’on appelle les Prestataires de services de certification électronique qui fonctionnent à travers un ensemble d’obligations légales pour créer un environnement électronique paisible.

Trust and security provided to operators via internet are among the major guarantees to be available so as electronic dealings flourish, which necessitates the creation of neuter systems that take in charge protection of these data and information exchanged between operators and confirmation of their correctness. the problematic posed is what are the systems created by foreign laws in general and the Algerian legislator in particular in providing these services in addition to the nature of engagements imposed on them by the legislator to guarantee and create a safe electronic environment to deal via Internet? The Algerian legislator in this field and by virtue of law 15-04 has created what is called provider of electronic certification services, which works through a set of legal engagements to create a safe electronic environment to deal via Internet.

إن توفير الثقة والأمان لدى المتعاملين عبر شبكة الإنترنت يأتيان في مقدمة الضمانات التي يتعين توافرها لازدهار التعاملات الإلكترونية وهو ما يتطلب استحداث أجهزة محايدة تتولى عملية حماية البيانات والمعلومات المتبادلة بين المتعاملين وتأكيد صحتها. فالإشكال المطروح ما هي الأجهزة التي استحدثتها التشريعات الأجنبية بصفة عامة والمشرع الجزائري بصفة خاصة لتقديم هذه الخدمات وما طبيعة الالتزامات التي فرضها المشرع عليها لضمان وخلق بيئة إلكترونية آمنة للتعامل عبر الإنترنيت؟ المشرع الجزائري في هذا المجال بموجب القانون 15-04، استحدث ما يسمى بمؤدي خدمات التصديق الإلكتروني والذي يعمل من خلال جملة من الالتزامات القانونية على خلق بيئة إلكترونية آمنة للتعامل عبر شبكة الإنترنيت.
