المستخلص: بالرغم من تقلص الاختصاص التشريعي للبرلمان، ومحدودية نطاق مساهمة أعضائه في التقدم بمشروعات القوانين، يبقى للسلطة التشريعية اختصاصها الأقوى وهو رقابة أعمال الحكومة من خلال وسائل الرقابة البرلمانية المتعددة، ومن أبرز هذه الوسائل التحقيق البرلماني، بعد كشف الحقيقة، حول موضوع معين، والاستيثاق من أداء الحكومة لمهامها، والحد من استبدادها، ومنعها من أن تطغى بسلطاتها. فقد تبوا التحقيق البرلماني مكانته في النظامين البرلماني والرئاسي، حتى أضحت أهمية التحقيق البرلماني ومكانته واضحة في النصوص اللائحية لمجلس النواب العراقي ونظيره الكويتي، وقد شكلت هذه النصوص بجماعها النظام الإجرائي للتحقيق البرلمانية. فكان لابد من مناقشة هذه النصوص وما ترتب عليها من ممارسات برلمانية، بعد أن قسمنا دراستنا إلى أربعة مباحث، عرضنا في الأول ماهية التحقيق البرلماني وأهميته، وفي الثاني تطرقنا للنظام الإجرائي للتحقيق، وفي المبحث الثالث ناقشنا ركائز التحقيق ومقوماته، أما المبحث الأخير فتناولنا فيه الأثر الدستوري للتحقيق البرلماني.

Despite the limited legislative competence of the parliament and the limited scope of participation of its members in the submission of draft laws, the legislative authority retains its strongest competence, which is to monitor government actions through various parliamentary oversight methods. The most prominent of these means is the parliamentary investigation after uncovering the truth about a specific case, authentication of the performance of the government’s own duties, the reduction of its authoritarianism and stopping it from misusing its power.
The Parliamentary Inquiry has taken its status in the parliamentary and presidential systems. The importance of the parliamentary investigation and its status became clear in the regulatory texts of the Iraqi Council of Representatives and its Kuwaiti counterpart. These texts formed a procedural system for the parliamentary investigation. It was necessary to discuss these texts and the findings of the parliamentary practices after we divided our study into four chapters. In the first chapter, we presented the analysis of the nature of the parliamentary inquiry and its importance. In the second chapter, we discussed the procedural system of investigation. In the third chapter, we discussed the structures of the investigation and its components. In the last chapter, we dealt with the constitutional impact of parliamentary investigation.

Despite the shrinking of the legislative competence of Parliament, and the limited scope of contribution by its members to the advancement of bills, the legislative authority remains with its strongest competence, which is to monitor the actions of the government through the various means of parliamentary supervision. One of the most prominent of these means is the parliamentary inquiry, after revealing the truth, on a particular subject, making sure that the government performs its tasks, limiting its tyranny, and preventing it from being overwhelmed by its powers. The parliamentary investigation has assumed its place in the parliamentary and presidential systems, and the importance of the parliamentary investigation and its position has become clear in the legislative texts of the Iraqi parliament and its Kuwaiti counterpart. These texts have all formed the procedural system of parliamentary investigation. It was necessary to discuss these texts and the consequent parliamentary practices, after we divided our study into four sections. In the first section, we presented the nature of the parliamentary investigation and its importance, in the second section we touched on the procedural system of the investigation, and in the third section we discussed the pillars and components of the investigation, and in the last section we dealt with the constitutional impact of the parliamentary investigation.
